<br />City of Sunny Isles Beach |Request for Proposal No. 21-06-01 11 <br /> <br />adjustment (to cost for services) under this provision, which shall not exceed 3%, or adjustment <br />to revenue share, which adjustment has no limit. For any adjustment to commence on the first day <br />of any exercised option period, the Bidder’s request for adjustment shall be submitted no later than <br />ninety (90) days prior to expiration of the then current contract term. In no event will the price be <br />increased or decreased by a percentage greater than the percentage change reflected in the C.P.I. <br />as published by the U.S. Department of Labor. If no adjustment request is received from the Bidder, <br />the City will assume that the Bidder has agreed the optional term may be exercised without pricing <br />adjustment. Any adjustment request received after the commencement of a new option period <br />may not be considered. <br /> <br />2.6 TAXES/LICENSES <br /> <br />Retail taxes and rental taxes and licensing are the responsibility of the Contractor and shall be <br />handled in accordance with Florida State Statutes. The successful contractor shall be responsible <br />for, at its own expense, obtaining all necessary permits and paying all licenses, fees and taxes, <br />required to comply with all local laws and ordinances; county, state and federal laws, rules and <br />regulations which are applicable to the business to be carried on under this contract. Successful <br />proposer shall be responsible for all sales tax, licenses, fees, etc., and shall not deduct such from <br />the percentage revenue fee owed to the City. <br /> <br />2.7 DELIVERY <br /> <br /> Unless otherwise indicated, all items shall be delivered F.O.B. with destination and delivery charges <br /> included in the proposal price. F.O.B. destination is interpreted to mean unloading and placing in <br /> the building or area as directed by the City. <br /> <br />2.8 INSURANCE <br /> <br /> Comprehensive General Liability with minimum limits of five million dollars ($5,000,000.00) per <br />occurrence for Bodily Injury and Property Damage Liability. Coverage must be afforded on a form <br />no more restrictive than the latest edition of the Comprehensive General Liability policy, without <br />restrictive endorsements, as filed by the Insurance Services Office, and must include: <br /> <br />o Premises and Operation <br />o Independent Contractors <br />o Products and/or Completed Operations Hazard <br />o Broad Form Property Damage <br />o Professional Liability <br />o Broad Form Contractual Coverage applicable to this specific contract, including any hold <br />harmless and/or indemnification agreement. <br />o Personal Injury Coverage with employee and Contractual Exclusions removed, with <br />minimum limits of coverage equal to those required for Bodily Injury Liability and Property <br />Damage Liability. <br /> <br /> Business Automobile Liability with minimum limits of one million dollars (1,000,000.00) per <br />occurrence combined single limit for Bodily Injury Liability and Property Damage Liability.
