Summary Minutes:Regular City Commission Meeting May 15,2014 City of Sunny Isles Beach,Florida <br /> Action: Mayor Edelcup gave opening remarks on zoning procedures/decorum. City Clerk <br /> Hines read a disclaimer for the Zoning hearing,and administered the oath to witnesses. City <br /> Planner Claudia Hasbun reported that this request includes a decrease in density from 223 to <br /> 192 dwelling units. Also it includes a slightly decreased FAR from 647,736 square feet to <br /> 645,597 square. They are also decreasing parking spaces from 429 to 422,and an increase of <br /> the front pedestal setback from 49 feet 11 inches to 51 feet 3 inches,as well as a side pedestal <br /> setback from the south side, from 27 feet 8 inches to 42 feet 1 inch. There were also some <br /> minor modifications submitted in the Plans that will not affect the overall design and layout <br /> of the project. All of these modifications are in compliance with the Land Development <br /> Regulations and with the Comprehensive Plan. All the conditions stipulated under the <br /> previous approved site plan will remain in effect if the site plan modification is approved. <br /> Public Speakers: Cliff Schulman, Esq.; Alan E. Krinzman, Esq. <br /> Cliff Schulman,Esq. representing Fortune Development Group, said this is unusual because <br /> he is not asking for anything except to allow him to do less development. When we opened <br /> our sales office we found a phenomenon that the size of units that were built before the 2008 <br /> bust were smaller and more numerous in these buildings averaging probably about 1,400 — <br /> 1,500 square feet. In the project that you approved in January, we had units averaging 2,750 <br /> square feet. Our purchaser said they wanted more, and so we increased the size of our units <br /> with prices running $1,700 to $1,900 a square foot. The units went from an average of 2,750 <br /> to about 3,400 square feet. This resulted in a reduction in the number of units, and the <br /> parking spaces for those units also went down. But we still have in excess of 38 spaces an <br /> excess of what the Code requires even with the down zoning of the parking. We increased <br /> our setbacks, and we believe we can even qualify as a minor modification which could have <br /> been administratively approved because under the Code they did not change lot coverage in <br /> setback, height increase or decrease as well as density and intensity. We didn't alter our <br /> request to variance,there is no change in the location of the building itself,there is no increase <br /> in the number of average daily trips. The change does not alter any ingress or egress to the <br /> site, it doesn't substantially decrease the value point of fact increasing the value of the <br /> property. And the change does not result in a material modification or cancellation of any <br /> condition that is not in our approval. <br /> Mr. Schulman presented renderings of the project. He said outlined in deep purple was the <br /> old footprint of the building,and what is in between it now in gray or blue is the new footprint <br /> of the building showing how it was basically brought in. The building is still going to look <br /> the same and he presented that rendering. It is going to be a truly signature building in Sunny <br /> Isles Beach. <br /> Alan Krinzman, Esq. on behalf of the Sands Pointe Condominium Association, said the <br /> Condo Association is not here to take issue with the requested modifications rather it seeks <br /> understanding of the requested modifications and suggested this item be deferred for 30 days. <br /> Mayor Edelcup asked Mr. Krinzman if he had met with the developers and he said no. Mayor <br /> Edelcup said what he is bringing up could be discussed with the developer. We had an <br /> original site plan approved back in January where all these particular issues presumably could <br /> have been brought up, and to bring them up now while we are talking about modifying <br /> 5 <br />
