Summary Minutes:Regular City Commission Meeting May 15,2014 City of Sunny Isles Beach,Florida <br /> something that was already approved and we are modifying it in a smaller capacity, suggests <br /> to him that he has a lot of valid points but at the same time he thinks those are the things that <br /> he should be bringing up with the developer as well as our City Building Official. Certainly <br /> our Building Official is not going to give them a permit to proceed unless he is satisfied with <br /> the engineering drawings and all the technical aspects of building it and so the safeguard is the <br /> City Official. City Attorney Ottinot said prior to meeting tonight, he introduced Mr. <br /> Krinzman to Cliff Schulman in order for him to meet with Mr. Schulman to address some of <br /> his concerns. Additionally he is welcome to meet with him or City Manager Russo or the <br /> Building Official to address his concerns. Mr. Krinsman said this information should be a <br /> matter of public record, and City Attorney Ottinot said anything that is filed with the City is <br /> subject to Florida Public Records Law. <br /> Mayor Edelcup said right now we are approving a concept,and then the developer goes back <br /> and submits all the technical and engineering drawings to the City, and at that time the City <br /> Building Officials get together and either approve or reject the items they see on that technical <br /> plan. City Attorney Ottinot said we can address all these concerns at the appropriate time. <br /> From a zoning perspective, the Commission jurisdiction is whether or not these submitted <br /> plans are consistent with the City's Zoning Code. <br /> Vice Mayor Aelion said as a point of disclosure,he is a resident of Sands Point, the subject <br /> property that has the concerns and was presented before us tonight. It is a matter of public <br /> record that there was an incident many months ago that created a situation where the <br /> construction site was a reason for concern by the Association at Sands Point. To that end he <br /> understands the position of the attorney presenting those concerns before us tonight. He <br /> believes they are valid and should be followed through. <br /> Commissioner Gatto moved and Commissioner Levin seconded a motion for approval, <br /> subject to staff conditions. Resolution No. 14-Z-139 was adopted by a roll call vote of 3- <br /> 1-1 [Vice Mayor Aelion against; Commissioner Scholl absent] in favor. <br /> Vote: Commissioner Gatto yes <br /> Commissioner Levin yes <br /> Commissioner Scholl absent <br /> Vice Mayor Aelion no <br /> Mayor Edelcup yes <br /> 7. ORDINANCES FOR FIRST READING <br /> 7A. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida,Amending <br /> Chapter 62 of the Code of Ordinances to Clarify that Purchases in Excess of$25,000.00 <br /> for Utilities Shall be Administratively Approved in the Adopted Fiscal Year Budget and <br /> Are Not Subject to the Requirements of Chapter 62 Unless Required by the City <br /> Commission; Providing for Severability; Providing for Inclusion in the Code;Providing for <br /> Repeal of Conflicting Provisions; Providing for an Effective Date. <br /> Action: City Clerk Hines read the title, and Deputy City Attorney Amuchastegui reported <br /> that currently all purchases in excess of$25,000 require City Commission approval,and the <br /> intent of this Ordinance is to clarify utility purchases in excess of $25,000 shall be <br /> 6 <br />
