Summary Minutes:Regular City Commission Meeting May 15,2014 City of Sunny Isles Beach,Florida <br /> administratively approved in the adopted fiscal year budget. This Ordinance also expands <br /> the definition of utilities to include electrical, water, natural gas, and telecommunication <br /> services. <br /> Public Speakers: None <br /> Vice Mayor Aelion moved and Commissioner Levin seconded a motion to approve the <br /> proposed Ordinance on first reading. The motion was approved by a roll call vote of 4- <br /> 0-1 (Commissioner Scholl absent)in favor. Second reading,public hearing will be held <br /> on Thursday,June 19, 2014, at 6:30 p.m. <br /> Vote: Commissioner Gatto yes <br /> Commissioner Levin yes <br /> Commissioner Scholl absent <br /> Vice Mayor Aelion yes <br /> Mayor Edelcup yes <br /> 7B. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida,Amending <br /> Chapter 256 of the Code of Ordinances to Prohibit the Use of Skateboards Along Collins <br /> Avenue and Sunny Isles Boulevard; Providing for Legislative Intent; Providing for <br /> Severability; Providing for Inclusion in the Code; Providing for Repealer; Providing for an <br /> Effective Date. <br /> Action:City Clerk Hines read the title,and City Attorney Ottinot reported that he conducted <br /> research on this item,and the first thing he did was to check with former City Commissioner <br /> Danny Iglesias of FDOT to determine if we had authority to ban skateboarding on Collins <br /> Avenue as it is a State road. Former Commissioner Iglesias said it was okay. He also <br /> checked with the General Counsel of DERM who also said it was okay. After that he <br /> conducted a research of other municipalities to see if they have done a similar Ordinance <br /> banning skateboarding, and they had. <br /> Public Speakers: Jake Wax; Allison Roma; Timothy Byrd <br /> Mayor Edelcup said this issue came up at the last Commission meeting because some <br /> residents were injured as a result of skateboarders on the main thoroughfares. At the end of <br /> that Commission meeting it was the consensus of the Commission to put together an <br /> ordinance that would try to balance the needs of our youth as well as our elderly people in <br /> our City and create a minimal invasion where skateboarding could no longer take place. It <br /> was decided by the Management and Commission to concentrate primarily on Sunny Isles <br /> Boulevard and Collins Avenue which are the only two (2) streets we are proposing in this <br /> Ordinance to be banned from skateboarding which leaves the rest of the side streets of the <br /> City for skateboarding. There have also been some suggestions to change the monetary fines <br /> that this Ordinance is proposing and limit it strictly to a public service contribution on behalf <br /> of anyone charged with skating in the wrong location. Basically he knows this is a hot topic <br /> with many of our residents, and he knows many young residents are here who are <br /> skateboarders. He noted that we do have a Skateboard Park, and we do have all the other <br /> streets besides Collins Avenue and Sunny Isles Boulevard that would permit the continuation <br /> of skateboarding including getting to the Skateboard Park. He asked City Manager Russo to <br /> expand on the revisions of the Ordinance. <br /> 7 <br />
