to City and shall be responsible for additional costs, if any, of the project to <br />the proportional extent caused by such negligent errors or omissions. <br />e. Despite any changes to or cancellation of insurance, the Artist remains responsible for <br />maintaining the required insurance coverage for the duration of the Agreement. <br />f. Failure of the Artist to comply with any of the terms of this Article 5 shall be considered <br />a material breach of this Agreement and cause for its immediate termination. <br />Insurance Policies <br />a. Commercial General Liability insurance policy, written on an occurrence form, <br />including all the usual coverage known as: <br />1. Premises and Ongoing Completed Operations — on a primary and <br />noncontributory basis including waiver of subrogation on behalf of the City <br />of Sunny Isles Beach. <br />2. products/completed operations <br />3. personal/advertising injury <br />4. contractual liability <br />5. broad -form property damage <br />6. independent contractor's liability <br />Said policy must provide the following minimum coverage: <br />1. $1,000,000 combined single limit per occurrence for bodily injury, personal <br />injury and property damage. <br />2. $1,000,000 annual aggregate <br />b. Business Automobile Liability with minimum limits of One Million Dollars <br />($1,000,000.00) per occurrence combined single limit for Bodily Injury Liability <br />and Property Damage Liability. Coverage must be afforded on a form no more <br />restrictive than the latest edition of the Business Automobile Liability policy, <br />without restrictive endorsements, as filed by the Insurance Services Office, and <br />must include: <br />a. Owned Vehicles; <br />b. Hired and Non -Owned Vehicles; <br />c. Employers' Non -City ship. <br />The Artist agrees to keep in good standing a valid driver's license at all times during <br />the term of this Agreement. <br />c. Transportation/Cartage insurance. Prior to shipment, the Artist must show the City <br />that the artwork is insured independently or by the carrier during its shipment to the <br />Site. <br />d. Installation Subcontractor Liability. Prior to installation, the Artist must provide City <br />with liability insurance certificate of any subcontractors involved in installation of the <br />Artwork at the Site. <br />e. Worker's Compensation Insurance & Employers Liability. Artist agrees to <br />16 <br />
