maintain Worker's Compensation Insurance & Employers Liability in accordance <br />with Florida Statute, Chapter 440, and where applicable, the United States <br />Longshoremen's and Harbor Worker's Act, the Federal Employers' Liability Act <br />and the Homes Act. Employer's Liability Insurance shall be provided with a <br />minimum of One Million Dollars ($1,000,000.00) per accident. Artist agrees to be <br />responsible for the employment, conduct and control of its employees and for any <br />injury sustained by such employees in the course of their employment. <br />f. Umbrella Insurance. Artist shall be required to purchase, maintain, and keep in full <br />force, effect, and good standing, Umbrella Liability Insurance above the primary <br />commercial general liability, automobile liability, and employers' liability policies <br />required herein. The limit shall not be less than Three Million Dollars <br />($3,000,000.00) each occurrence and annual aggregate per occurrence during the <br />initial and any renewal term of this Agreement. <br />g. Additional Insured: The Artist agrees to endorse the City as an Additional Insured <br />on all policies set forth in this Exhibit C, and the City of Sunny Isles Beach, <br />Contract Number, and Title, must appear on each Certificate of Insurance. All <br />Certificates of Insurance must remain active during the term of the contract. <br />h. Waiver of Subrogation: Artist agrees to provide a Waiver of Subrogation for each <br />required policy herein. When required by the insurer, or should a policy condition <br />not permit Artist to enter into a pre -loss agreement to waive subrogation without an <br />endorsement, then Artist agrees to notify the insurer and request the policy be <br />endorsed with a Waiver of Transfer of Rights of Recovery Against Others, or its <br />equivalent. This Waiver of Subrogation requirement shall not apply to any policy, <br />which includes a condition specifically prohibiting such an endorsement, or voids <br />coverage should Artist enter into such an agreement on a pre -loss basis. <br />17 <br />
