maintain Worker's Compensation Insurance & Employers Liability in accordance with Florida Statute, Chapter 440, and where applicable, the United States Longshoremen's and Harbor Worker's Act, the Federal Employers' Liability Act and the Homes Act. Employer's Liability Insurance shall be provided with a minimum of One Million Dollars ($1,000,000.00) per accident. Artist agrees to be responsible for the employment, conduct and control of its employees and for any injury sustained by such employees in the course of their employment. f. Umbrella Insurance. Artist shall be required to purchase, maintain, and keep in full force, effect, and good standing, Umbrella Liability Insurance above the primary commercial general liability, automobile liability, and employers' liability policies required herein. The limit shall not be less than Three Million Dollars ($3,000,000.00) each occurrence and annual aggregate per occurrence during the initial and any renewal term of this Agreement. g. Additional Insured: The Artist agrees to endorse the City as an Additional Insured on all policies set forth in this Exhibit C, and the City of Sunny Isles Beach, Contract Number, and Title, must appear on each Certificate of Insurance. All Certificates of Insurance must remain active during the term of the contract. h. Waiver of Subrogation: Artist agrees to provide a Waiver of Subrogation for each required policy herein. When required by the insurer, or should a policy condition not permit Artist to enter into a pre -loss agreement to waive subrogation without an endorsement, then Artist agrees to notify the insurer and request the policy be endorsed with a Waiver of Transfer of Rights of Recovery Against Others, or its equivalent. This Waiver of Subrogation requirement shall not apply to any policy, which includes a condition specifically prohibiting such an endorsement, or voids coverage should Artist enter into such an agreement on a pre -loss basis. 17
