<br />City of Sunny Isles Beach |Request for Qualifications No. 21-11-01 11 <br /> <br />standing, Umbrella Liability Insurance above the primary commercial general liability, <br />automobile liability, and employers' liability policies required herein. The limit shall not be <br />less than One Million Dollars ($1,000,000.00) each occurrence and annual aggregate per <br />occurrence during the initial and any renewal term of this Agreement. <br /> <br /> 2.10.3 Worker’s Compensation Insurance <br /> <br />Worker's Compensation Insurance for statutory obligations imposed by Worker's <br />Compensation or Occupational Disease Laws, including, where applicable, the United States <br />Longshoremen's and Harbor Worker's Act, the Federal Employers’ Liability Act and the Homes <br />Act. Employer's Liability Insurance shall be provided with a minimum of One Million Dollars <br />($1,000,000.00) per accident. Consultant agrees to be responsible for the employment, <br />conduct and control of its employees and for any injury sustained by such employees in the <br />course of their employment. <br /> <br />2.10.4 Professional Liability Insurance <br /> <br />Professional Liability Insurance including Errors and Omissions with minimum limits of One <br />Million Dollars ($1,000,000.00) per occurrence. <br /> <br />2.10.5 Cancellation and Re-Insurance <br /> <br />If any insurance should be cancelled or changed by the insurance company or should any <br />insurance expire during the period of this contract, the Consultant shall be responsible for <br />securing other acceptable insurance to provide the coverage specified in this section to <br />maintain coverage during the life of this Contract. All deductibles must be declared by the <br />Consultant and must be approved by the City. At the option of the City, either the <br />Consultant shall eliminate or reduce such deductible or the Consultant shall procure a Bond, <br />in a form satisfactory to the City, covering the same. <br /> <br />2.10.6 Errors and Omissions Liability <br /> <br />Errors and Omissions Liability insurance with minimum coverage limits of $1,000,000.00 <br />each occurrence. Consultant acknowledges that the City is relying on the competence of <br />the Consultant to design the project to meet its functional intent. If it is determined during <br />construction of the project that changes must be made due to Consultant's negligent errors <br />and omissions, Consultant shall promptly rectify them at no cost to City and shall be <br />responsible for additional costs, if any, of the project to the proportional extent caused by <br />such negligent errors or omissions. <br /> <br />2.10.7 General <br /> <br />City reserves the right to review and revise any insurance requirements at the time of renewal or <br />amendment of any Contract the parties enter into, including, but not limited to, deductibles, limits, <br />coverage, and endorsements based on insurance market conditions affecting the availability or <br />affordability of coverage, or changes in the scope of work or specifications that affect the
