For the potential use of some participating agencies, the opportunity is <br />afforded to all proposers to provide the option to pre -arrange purchase of <br />fixed volume(s) of product(s) at a fixed price from time to time thereby <br />assuring: <br />i. Product availability of fixed volume(s) on a ratable basis over a <br />defined period of time, presumable in monthly increments. <br />ii. Established pre -agreed fixed pricing point(s) for product(s) <br />during that established period of time, regardless of market <br />conditions. <br />Proposers wishing to provide an alternate proposal on a fixed volume/fixed price <br />basis should provide minimum and, if applicable, maximum monthly volumes <br />applicable or percentage of agency estimated ratable demand that could be <br />contracted for on this basis. If available, provide a copy of standard terms and <br />conditions that would generally apply to such a transaction. <br />9. Addenda, Additional Information: <br />Any addenda or answers to written questions supplied by the City to potential <br />proposers become part of this Request for Proposal and any resulting contract. <br />The proposal form should be signed by an authorized company representative, <br />dated and returned with the proposal. <br />10. Contract with Participating Agencies: <br />No negotiations, decisions or action shall be initiated or executed by the Offeror <br />as a result of any discussions with any participating agency or representative of <br />those agencies. Only those communications, which are in writing from the <br />Purchasing Agent, or other designee, of the City of Pompano Beach may be <br />considered as a duly authorized expression. Also, only communications from <br />Offerors that are signed and in writing will be recognized by the City as duly <br />authorized expressions on behalf of the Offeror. <br />Litigation: <br />Disclose any litigation within the past five (5) years arising out your firm's performance. <br />City Forms: <br />The RFP Proposer Information Page Form and any other required forms must be <br />completed and submitted electronically through the City's eBid System. <br />F. Insurance <br />The insurance described herein reflects the insurance requirements deemed necessary <br />for this contract by the City. It is not necessary to have this level of insurance in effect at <br />the time of submittal, but certificates indicating that the insurance is currently carried or a <br />letter from the Carrier indicating upgrade ability will speed the review process to <br />determine the most qualified Proposer. <br />9 <br />
