<br />City of Sunny Isles Beach |Request for Proposal No. 22-04-01 10 <br /> <br />Section 2 <br />Special Terms and Conditions <br /> <br />2.1 PURPOSE OF RFP <br /> <br />The City of Sunny Isles Beach (the "City"), a municipality located in Miami-Dade County, <br />Florida, is requesting proposals from qualified proposers (“Proposers”, “Bidders”, “Contractors” <br />or “Firms”) to complete the installation of fiber through designated pathways, primarily consisting <br />of existing conduit, as well as deployment of additional conduits necessary to reach designated <br />City facilities. All fiber routes will be installed to fall within the public right-of-way (ROW), existing <br />utility easements, or other property to which the City has legal access. Contractor shall be <br />responsible for obtaining applicable permits. The Contractor must provide signed and sealed As- <br />Built Plans upon completion of the project. GIS files can be obtained upon an addendum request. <br /> <br />This project may be supported, in whole or in part, by Federal Grant funding. On March 11, 2021, <br />the American Rescue Plan Act (“ARPA”) was signed into law, and established the Coronavirus State <br />Fiscal Recovery Fund and Coronavirus Local Fiscal Recovery Funds, which together make up the <br />Coronavirus State and Local Fiscal Recovery Funds (“SLFRF”) program. This program is intended <br />to provide support to State, territorial, local, and Tribal governments in responding to the <br />economic and public health impacts of COVID-19 and in their efforts to contain impacts on their <br />communities, residents, and businesses. <br /> <br />To the extent applicable, in accordance with Federal law, proposers shall comply with the clauses <br />as enumerated below, and attached hereto as Attachment “A”. Proposer shall adhere to all grant <br />conditions as set forth in the requirements of Agreement No. Y5301 which have been provided to <br />Proposer as Attachment “C”, along with any and all other applicable Federal Laws. Including, but <br />not limited to, those set forth below, as well as those listed below, which are incorporated herein <br />by reference: <br />a. 2 CFR. 25.110 <br />b. 2 CFR Part 170 (including Appendix A), 180, 200 (including Appendixes), and 3000 <br />c. Executive Orders 12549 and 12689 <br />d. 41 CFR s. 60-1(a) and (d) <br />e. Consolidated Appropriations Act, 2021, Public Law 116-260 related to salary limitations <br />These cited regulations are hereby incorporated and made part of this solicitation as if fully set <br />forth herein. As stated above, this list is not all inclusive, any other requirement of law applicable <br />in accordance with the Federal, State or grant requirements are also applicable and hereby <br />incorporated into this solicitation. If Proposer cannot adhere to or objects to any of the applicable <br />federal requirements, Proposers proposal may be deemed by the City as unresponsive. <br /> <br /> <br />
