Hasbun, AICP, Planning and Zoning Director <br />March 15, 2022 <br />Small Scale Comprehensive Plan Future Land Use Map (FLUM) Amendment <br />The City has analyzed and prepared a small scale Comprehensive Plan Future Land Use Map (FLUM) <br />Amendment. The proposed amendment affects only the property located at 215 185 St, Sunny Isles Beach, <br />FI 33160 with Folio No. 31-2202-006-0010 (the "Property"). The amendment is to modify the Property <br />FLUM designation of Low to Medium Density Residential to Community Facilities. <br />The Property <br />The Property is approximately 29,290 square feet or 0.672 acres. This Property was donated to the City <br />in accordance to Zoning Resolution No. 14-Z-143 and Resolution No. 2014-2275. Consequently, the City <br />obtained the deed to the Property on July 29, 2016, legally described under Exhibit "A". The current <br />condition of the Property includes a one-story trailer of 9,120 sq. ft. and 25 parking spaces. <br />Analysis <br />The FLUM amendment is from Low to Medium Density Residential to Community Facilities. The current FLUM <br />designation allows for residential for up to 13 dwelling per gross acre. The proposed designation to <br />Community Facilities allows for up to 25 residential care facilities and 2.0 of non-residential FAR. <br />FROM: 0.672 x 13 = 8 residential units <br />TO: 0.672 x 25 = 16 residential units <br />0.672 (29,290) x 2.0 = 58,580 square feet of non-residential FAR <br />As set forth more particularly below, the Property was donated to the City in exchange for Transfer <br />Development Rights (TDRs), and is therefore deemed a Sender site. According to the City Comprehensive <br />Plan and Land Development Regulations, as a result of the above referenced exchange, all private <br />development rights related to the density and intensity were transferred and severed from the Property, <br />and the Property is required to be used for a public purpose consistent with the Comprehensive Plan, <br />specifically Policy 14C. The Comprehensive Plan stipulates and requires that properties in exchange for TDRs <br />meet and accomplish a public purpose. In this case, Policy 14 C d) specifies uses consistent with the <br />Comprehensive Plan such as public parks, plazas and/or open space, or other essential public facilities. <br />PZ2022-02 <br />100 <br />
