<br />City of Sunny Isles Beach |Request for Proposal No. 22-09-01 30 <br /> <br />exterior walls, roof and utilities beyond connection to the building on the Premises, including <br />structural or nonstructural, ordinary or extraordinary. <br /> <br />III. Parties' Rights. If either party refuses or neglects to make repairs or maintain the <br />Premises, or any part thereof, in a manner reasonably satisfactory to the other, without prejudice <br />to any other remedy, upon giving 10 days prior written notice, such party shall have the right to <br />perform such maintenance or make such repairs on behalf of and for the account of the other. In <br />the event a party so elects, the other shall pay the cost of such repairs, maintenance, or <br />replacements within 5 days following receipt of a bill therefor. Tenant agrees to permit Landlord <br />or its agent to enter the Premises, upon reasonable notice by Landlord, during normal business <br />hours for the purpose of inspecting the Premises. <br /> <br />3.3 OPERATION PHASE <br /> <br />The selected Proposer shall operate the facility and related activities in a manner associated with <br />high quality food service standards. The scope of services, include but are not limited to: <br /> <br /> A. Management and Operation Services <br /> <br />1. The restaurant shall have a family atmosphere and may have live entertainment. At no time <br />may the restaurant operate as a night club. <br /> <br />2. The selected Proposer's staff shall be distinctively uniformed so as to be distinguishable as the <br />selected Proposer's staff and not as employees of the City. <br /> <br /> B. Food Service: <br /> <br />1. At a minimum, the Proposer shall provide food service at the Restaurant during regularly <br />scheduled operating hours as approved by the City, which may include breakfast, lunch and <br />dinner type service with or without alcoholic beverages to the general public seven days a <br />week. The selected Proposer shall be responsible for any and all licenses required for <br />delivering such services. <br /> <br /> The selected Proposer may provide additional services for a fee, such as birthday parties, <br />catering, group sales, banquets, etc., only if it does not affect the general operation and <br />operating hours of the restaurant and does not interfere with the normal operations of <br />Government Center. <br /> <br />2. The selected Proposer shall maintain all food service amenities and equipment in a safe and <br />careful manner as outlined in the Florida Health Hygiene Codes and Standards (see <br />Attachment "B"). <br /> <br /> <br /> <br />END OF SECTION
