or modified. The Chief of Police or his / her designee shall conduct a meeting with the grievant and <br />his / her PBA representative, if needed. The Chief of Police or his/her designee shall, within ten (10) <br />calendar days (or such longer period of time as is mutually agreed upon in writing), render his/her <br />decision in writing to the aggrieved employee. <br />Step 5: If the grievance is not resolved at Step 4, or if no written disposition is made <br />within the Step 4 time limits, he/she shall have the right to appeal the Step 4 decision to the City <br />Manager or his or her designee within seven (7) calendar days of the date of the issuance of the Step <br />4 decision. Such appeal must be accompanied by the filing of a copy of the original written grievance, <br />together with a request form signed by the employee requesting that the Step 3 decision be reversed <br />or modified. The City Manager or his/her designee shall conduct a meeting with the grievant and his <br />/ her PBA representative, if needed. The City Manager or his/her designee shall, within ten (10) <br />calendar days (or such longer period of time as is mutually agreed upon in writing), render his/her <br />decision in writing to the aggrieved employee. <br />Step 6: Arbitration. If the decision of the City Manager has not satisfactorily resolved <br />the grievance, the Association may request arbitration in writing to the Director of Human Resources <br />no later than fifteen (15) working days after the rendering of such decision by the City Manager. At <br />the arbitration hearing the parties shall be accompanied by their representatives and both sides may <br />be represented by legal counsel. The arbitrator shall have access to all written documents and <br />statements pertaining to the grievance. The arbitrator shall render his/her decision no later than thirty <br />(30) days after the conclusion of the final hearing, or at such other time that is mutually agreed to by <br />the parties. Copies of the findings of the arbitrator, made in accordance with the jurisdictional <br />authority under this Agreement, shall be furnished to both parties and shall be final and binding on <br />both parties. <br />Appointment of Arbitrator: The parties shall attempt to mutually agree on an Arbitrator. If the <br />parties cannot so agree, the parties will request a list of arbitrators from the Federal Mediation and <br />Conciliation Service ("FMCS"). The Arbitrator shall be selected and shall conduct the arbitration <br />proceedings in accordance with the arbitration rules of the FMCS. <br />Powers of Arbitrator: The Arbitrator's decision shall be in writing and shall set forth the Arbitrator's <br />opinion and conclusions on the issues submitted and appropriate remedies. The Arbitrator shall limit <br />his/her decisions to the application and interpretation of the provisions of this Agreement and shall <br />-18- <br />
