Contractor agrees to maintain Business <br />Automobile Liability at a limit of liability not less than $1,000,000 per Occurrence <br />combined single limit for Bodily Injury Liability and Property Damage Liability. Coverage <br />must be afforded on a form no more restrictive than the latest edition of the Business <br />Automobile Liability policy, without restrictive endorsements, as filed by the Insurance <br />Services Office, and must include: Owned, Non -Owned & Hired automobiles, and Employers' <br />Non -City ship. <br />13.4 Worker's Compensation & Employer's Liability. Worker's Compensation <br />Insurance for statutory obligations imposed by Worker's Compensation or Occupational <br />Disease Laws, including, where applicable, the United States Longshoremen's and Harbor <br />Worker's Act, the Federal Employers' Liability Act and the Homes Act. 4. Workers' <br />Compensation in accordance with Florida Statute, including Employer's Liability of <br />$1,000,000. Contractor agrees to be responsible for the employment, conduct and control of its <br />employees and for any injury sustained by such employees in the course of their employment. <br />13.5 Builder's Risk Insurance. Coverage shall be "All Risk" coverage for one hundred <br />percent (100%) of the completed value of the structure(s), building(s) or addition(s). Where <br />Contract calls for install of machinery or equipment, the policy must be endorsed to provide <br />coverage on "All Risk" basis during transit and installation. The policy must be issued with a <br />deductible of not more than $50,000 per claim. <br />13.6 Waiver of Subrogation. Contractor agrees by entering into this written Contract <br />to a Waiver of Subrogation in favor of the City, Contractor, Sub -Contractors, Architects, or <br />Engineer for each required policy providing coverage during the life of this Contract. When <br />required by the insurer, or should a policy condition not permit the Contractor to enter into a <br />pre -loss Contract to waive subrogation without an endorsement, the Contractor agrees to <br />notify the insurer and request the policy be endorsed with a Waiver of Transfer of Rights of <br />Recovery Against Others, or an equivalent endorsement. This Waiver of Subrogation <br />requirement shall not apply to any policy, which includes a condition that specifically prohibits <br />such an endorsement, or voids coverage should the Contractor enter into such Contract on a pre - <br />loss basis. <br />13.7 Right to Revise or Reject. Contractor agrees the City reserves the right, but not <br />the obligation, to review or revise any insurance requirement, not limited to limits, coverages <br />and endorsements based on insurance market conditions affecting the availability or <br />affordability of coverage; or changes in the scope of work specifications affecting the <br />applicability of coverage. Additionally, the City reserves the right, but not the obligation, to <br />review and reject any insurance policies failing to meet the criteria stated herein, or any <br />insurer(s) providing coverage due of its poor financial condition or failure to operating legally <br />in the State of Florida. In such events, City shall provide Contractor written notice of such <br />revisions or rejections. <br />13.8 Certificate of Insurance. Contractor agrees to provide City a Certificate of <br />Insurance evidencing that all coverages, limits and endorsements required herein are <br />maintained and in full force and effect, and Certificates of Insurance shall provide a minimum <br />thirty (30) day endeavor to notify, when a manuscript notice endorsement is available by <br />32 <br />
