The amount of damage suffered by the City is difficult, if not impossible to <br />determine at this time. <br />The firm shall pay the City, as liquidated damages, $1,000.00 per calendar day of delay to mobilize <br />in the City with the resources required to begin debris removal operations within twenty-four <br />(24) hours of being issued Notice to Proceed. The Debris Monitor will make every attempt to <br />perform the awarded services within the time frame(s) requested. Repeated failure to timely <br />perform services may result in termination of the Agreement for cause and shall be cause in- need <br />for the City to procure in the open market services meeting or similar to those specified in the <br />Agreement and obligate the Debris Monitor to pay the City any increase in costs occasioned <br />thereby. <br /> These amounts are not penalties but liquidated damages to the CITY. Liquidated damages are <br />hereby fixed and agreed upon between the parties, recognizing the impossibility of precisely <br />ascertaining the amount of damages that will be sustained by the CITY as a consequence of such <br />delay, and both parties desiring to obviate any question of dispute concerning the amount of said <br />damages and the cost and effect of the failure of the CONTRACTOR to complete the Contract on <br />time. <br />2.8 INSURANCE REQUIREMENTS <br /> The Consultant, and its subcontractors, sub-consultants, assignees and suppliers, at its <br /> own expense, shall keep in force and at all times maintain during the term of this Agreement: <br /> <br /> 2.8.1 Comprehensive General Liability <br /> <br /> Comprehensive General Liability with minimum limits of One Million Dollars ($1,000,000.00) per <br />occurrence combined single limit for Bodily Injury Liability and Property Damage Liability. <br />Coverage must be afforded on a form no more restrictive than the latest edition of the <br />Comprehensive General Liability policy, without restrictive endorsements, as filed by the <br />Insurance Services Office, and must include: <br /> <br />o Premises and Operation <br />o Workers Compensation (Statutory) <br />o Independent Contractors <br />o Products and/or Completed Operations Hazard <br />o Broad Form Property Damage <br />o Broad Form Contractual Coverage applicable to this specific Contract <br />o Personal Injury Coverage with Employee and Contractual Exclusions removed, with <br />minimum limits of coverage equal to those required for Bodily Injury Liability and Property <br />Damage Liability. <br /> <br /> 2.8.2 Professional Liability Insurance <br />
