cost of the CONTRACTOR and be deemed part of the Guaranteed Maximum Price, except for <br />changes outside the scope of the Work. CONTRACTOR understands and agrees that any information <br />provided to it by the CITY as to any aspect of the Project is not guaranteed. The CITY'S review of <br />the design plans shall not be deemed an acceptance of the plans nor be deemed a pre - approval related <br />to the permitting process that the plans will be required to undergo with the Building Department. <br />6.4.1.5 CONTRACTOR shall prepare and submit for review to the CITY a <br />90% design package consisting of drawings and specifications for the mechanical, plumbing, <br />electrical, equipment, instrumentation and all other related work necessary to have a fully functional <br />and completed Project. <br />The CONTRACTOR understands and agrees that the CITY, may at its sole discretion, <br />require changes to the 90% percent design. All such changes shall be made at the sole and exclusive <br />cost of the CONTRACTOR and be deemed part of the Guaranteed Maximum Price, except of <br />changes outside the scope of the Work CONTRACTOR understands and agrees that any information <br />provided to it by the CITY as to any aspect of the Project is not guaranteed. The CITY'S review of <br />the design plans shall not be deemed an acceptance of the plans nor be deemed a pre - approval related <br />to the permitting process that the plans will be required to undergo with the Building Department. <br />6.4.1.6 CONTRACTOR shall prepare and submit for review to the CITY an <br />"Issued for Construction" design package, which necessarily includes Plans and Specifications, that <br />the CONTRACTOR is obligated to produce to the complete satisfaction of the CITY which is deemed <br />one hundred percent (100 %) complete for the construction of the entire Project, which are signed and <br />sealed by a Florida Licensed Engineer and which are sufficient to secure a permit for the construction <br />of the entire Project. The CITY shall not make any changes to the Plans and Specifications at 100% <br />percent design if CONTRACTOR satisfies all comments made by the CITY at 90% percent design. <br />The CITY'S review of the design plans shall not be deemed an acceptance of the plans nor be deemed <br />a pre - approval related to the permitting process that the plans will be required to undergo with the <br />Building Department. The construction phase of the Project shall not commence until the Building <br />Department has issued a permit based on the 100% "Issued for Construction" design package. <br />6.4.2 Once the 100% completed "Issued for Construction" design package has received a <br />permit from the Building Department to commence construction, these Drawings and Specifications <br />shall then be considered part of the Contract Documents. <br />6.4.3 The CONTRACTOR agrees that any and all revisions that the Florida Building Code <br />may require to the "Issued for Construction" Drawings and Specifications shall be the responsibility <br />of the CONTRACTOR and be so revised at the sole and exclusive cost of the CONTRACTOR and <br />be deemed part of the Guaranteed Maximum Price. <br />6.4.4 The CONTRACTOR shall provide to CITY three (3) record sets and three (3) <br />working sets of full size prints of the Drawings and Specifications. CONTRACTOR shall signify, by <br />affixing an endorsement (seal/signature, as appropriate) on every sheet of the record set, that the Work <br />shown on the endorsed sheets was produced by CONTRACTOR. With the record set of prints, <br />CONTRACTOR shall submit a final set of approved design computations to the CITY. The <br />11 <br />
