A true and <br />correct copy of this log shall be submitted with each Payment Request and receipt of <br />same by the City's Representative shall be a condition precedent for approval of the <br />Payment Request. <br />7.12 Cleaning the Site and the Project <br />7.12.1 The Contractor shall keep the site clean during performance of the <br />Work, shall remove debris, trash, and garbage from the Site daily and allow no <br />accumulation of debris, garbage, or trash on the Site. Upon Final Completion of the <br />Work, the Contractor shall clean the site and the Project and remove all waste, together <br />with all the Contractor's property therefrom. <br />7.13 Access to Work <br />7.13.1 The City, the City's Representative, and the Public Work's Department shall <br />have access to the Work at all times from commencement of the Work through Final <br />Completion. The Contractor shall take whatever steps necessary to provide access when <br />requested. <br />7.14 Safety <br />7.14.1 The Contractor shall take all reasonable precautions for safety of, and <br />shall provide reasonable protection to prevent damage, injury or loss to, its employees on <br />the Work and all other persons who may be affected thereby; the Work and materials and <br />equipment to be incorporated therein; and all other property at the site or adjacent thereto <br />including, but not limited to, trees, shrubs, lawns, walks, pavements, roadways, <br />structures, and utilities not designated for removal, relocation, or replacement in the <br />course of construction. The Contractor shall comply with all applicable laws, <br />ordinances, rules, regulations and lawful orders of public authorities bearing on safety <br />of persons or property or their protection from damage, injury or loss, and shall give all <br />notices required by same; this requirement includes, but is not limited to, the United <br />States Occupational Safety and Health Act and the Florida Trench Safety Act, Florida <br />Statute § 553.60. <br />7.15 Indemnity <br />7.15.1 To the fullest extent permitted by law, CONTRACTOR shall indemnify <br />and hold harmless CITY, its officers, officials, and employees, from liabilities, damages, <br />losses, and costs, including, but not limited to, reasonable attorneys' fees, to the extent <br />caused by the negligence, omissions, recklessness, or intentional wrongful misconduct of <br />CONTRACTOR and persons employed or utilized by CONTRACTOR in the performance <br />of this Contract. This indemnification shall survive the term of this Contract. <br />17 <br />
