Further, the City Manager reserves the right, if it is in the best <br />interests of the City, to negotiate with the sole bidder/proposer for the best terms, conditions and <br />price. A reference check of the low responsive bid resulted in a positive recommendation. For <br />instance, a reference submitted for a similar project came from Miami -Dade County for their MDWASD <br />PUMP STATION 0698 project. The reference stated "Exceptional" in all the categories regardin, <br />performance and commitment to their project, a comment included in the Reference Form was <br />"Contractor went above & beyond." <br />Furthermore, pursuant to Florida Statutes 255.05, (a) "A person entering into a formal contract with <br />the state or any county, city, or political subdivision thereof, for the construction of a public building, <br />for the prosecution and completion of a public work, or for repairs upon a public building or public <br />work shall be required, before commencing the work or before recommencing the work after a <br />default or abandonment, to execute and record in the public records of the county where the <br />improvement is located, a payment and performance bond with a surety insurer authorized to do <br />business in this state as surety." Based on this requirement, interested bidders must have bonding <br />capacity to meet this requirement. <br />The Minimum Qualification Requirements (MQRs) the bidders must have met in order to be deemec <br />responsive were: <br />1. Certified General Contractor with the State of Florida; <br />2. The Proposing bidder must have been awarded Prime Contractor and successfully performec <br />three (3) projects of similar or greater size, scope, and complexity; <br />3. Bidder shall provide reference letters for no less than three (3) projects in which Contractor <br />served as Prime Contractor; <br />4. Bidders shall have a single project bonding capability of at least $3,000,000.00 with a surety <br />company with an A.M. Best rating of AA or better. <br />On August 4, 2023, the City Engineer and Purchasing met with the vendor to negotiate the bid. Upor <br />thorough evaluation of the bid following the guidelines published in the solicitation, and a bid <br />negotiating meeting with the bidder, it is recommended to award and enter into an agreement with <br />the lowest responsible and responsive bidder: Comtech Engineering, Inc. for negotiated amount of <br />$4,163,766.00 with a ten percent contingency for a total award amount of $4,580,142.60. <br />FUNDING SOURCE: <br />Funds have been appropriated in account no. 300-5-5410/450-5-5380-465000-20004. <br />ATTACHMENTS: <br />Resolution <br />Agreement <br />Item Number: 10.J <br />271 <br />
