RedSpee& Florida,LLC <br />23. REDSPEED shall provide to the Customer access to RedCheck system, which provides the <br />Customer with ability to run and print all standard system reports. <br />24. If required by the Customer, REDSPEED shall, at REDSPEED' expense provide the Customer with, <br />and train a local expert witness able to testify in administrative proceedings and in court on <br />matters relating to the accuracy, technical operations, and effectiveness of the IPE System until <br />judicial notice is taken. <br />25. In those instances where damage to a Camera System or sensors is caused by negligence on the <br />part of the Customer or its authorized agent(s), REDSPEED will provide Customer an estimate of <br />the cost of repair. Upon authorization to proceed with the repairs or replacement, REDSPEED <br />shall replace or repair any damaged equipment and invoice for the pre -approved repair cost. <br />REDSPEED shall bearthe cost to replace or repair equipment damaged in all other circumstances. <br />26. REDSPEED shall provide a toll-free, Customer -specific help line to help the Customer resolve any <br />problems encountered regarding its Red Light Camera System and/or citation processing. The <br />help line shall function during normal business hours. Call Center hours for violators is Monday - <br />Friday 9:00 AM to 5 PM EST; IVR for violators is 24 x 7, 365 days. <br />27. As part of its turnkey system, REDSPEED shall provide Owners with the ability to view Recorded <br />Images of Violations involving their motor vehicles online. This online viewing system shall <br />include a link to the REDSPEED payment website(s) and may offer the opportunity to download <br />a form of affidavit to establish an exemption under Section 316.0083(1)(d) of the Florida <br />Statutes. Online obtained affidavits submitted in response to a Notice of Violation or Uniform <br />Traffic Citation shall be directed to and processed by REDSPEED and communicated to Customer <br />via the RedCheck system. REDSPEED shall adhere to timelines and other regulations specified in <br />Section 316.0083 of the Florida Statutes in the processing of affidavits. <br />28. Upon expiration of the due date of the Notice of Violation, RedCheck shall issue a Uniform Traffic <br />Citation, which shall be delivered by certified mail to the Owner within the statutory period. The <br />issuance of the Uniform Traffic Citation shall be based on the Traffic Infraction Enforcement <br />Officer's approval. Additional fee for mailing of Uniform Traffic Citation, assuming no return <br />receipt is required, will be billed per unit as published by the U. S. Postal Service. <br />29. REDSPEED shall charge, collect, and retain a maximum convenience fee of 5.00% each for <br />electronic payments provided. Such fee is paid by the violator. City will not receive any of said <br />convenience fee. City assumes no liability, responsibility, or control for said fee sought by <br />REDSPEED. <br />Page 13 1 19 <br />
