40 <br />Update, June 2019. <br /> <br />What is worker’s compensation? <br /> <br />• Worker’s compensation is a system of state laws that o riginated in 1911. <br />• These laws provide medical care and compensation to injured workers on a no-fault basis, <br />only! <br />• Worker’s compensation laws operate in all states. <br />• There are also worker’s compensation programs that cover federal employees, <br />longshoremen, merchant seamen, railroad employees and coal miners. <br />One way to avoid sustaining a workplace injury or illness --or at least lessening the blow- is by <br />wearing the proper safety gear and following workplace safety procedures. If it turns out t hat your <br />protective gear and safety training weren’t enough to protect you likely have a worker’s <br />compensation claim. <br /> <br /> <br /> <br /> <br />Workers compensation “fraud” occurs when someone knowingly makes false representation of a <br />material fact to obtain or to deny worker’s compensation benefits or to avoid responsibility under <br />the law. <br /> <br />Worker’s compensation “fraud” is the act of making false or fraudulent injuries to worker’s <br />compensation (insurance) claim. It may commit by any employee who “f a k e s” an injury to collect <br />benefits, would be committing “fraud”. <br /> <br />Claimant fraud. <br /> <br />➢ Maintaining or exaggerating of symptoms. <br />➢ Working while allegedly and not reporting income. <br />➢ Claiming a job-related injury that never occurred. <br />➢ Claiming a job-related injury as a work-related injury. <br />➢ Falsifying reports of injuries, that never happens. Investigation procedures to find out the <br />correct answers for such injuries. <br /> <br /> <br />
