City to retain Contractor to perform the needed maintenance services. <br />Pursuant to Section 62-12 of the City's Purchasing Code the City Commission may authorize the waiver <br />of competitive bidding procedures upon the recommendation of the City Manager that it is in the City's <br />best interest to do so. <br />The City Manager, after conducting his due diligence, found that it was in the best interest of the City to <br />waive formal competitive bidding procedures, and on April 29, 2020, the City Manager exercised his <br />authority and entered into an Agreement with the Contractor to provide the Services to the City, in an <br />amount not to exceed $31,480.00 in order to preserve all warranties and ensure continuity of service <br />and City staff negotiated the initial term of the Agreement for 1 year with 4 (1 renewal options). <br />On April 15th, 2021, via Resolution No. 2021-3186, the City Commission approved a 1st Amendment to <br />the Agreement, thereby exercising the first of 4 renewals, in an amount not to exceed $31,480.00 <br />On April 12th, 2022, via Resolution No. 2022-3313, the City Commission approved a 2nd Amendment <br />to the Agreement, thereby exercising the second of 4 renewals, in an amount not to exceed $31,480.00. <br />On April 20th, 2023, via Resolution No. 2023-3492, the City Commission approved a 3rd Amendment to <br />the Agreement, thereby exercising the third of four renewals, in an amount not to exceed $31,480.00. <br />The City Commission now wishes to approve a 4th Amendment to the Agreement with the Contractor, <br />thereby exercising its fourth and final renewal option, to provide HVAC annual maintenance services <br />located in the Government Center, in an amount not to exceed $31,480.00, bringing the total contract <br />amount to not to exceed $157,400.00. <br />ADDITIONAL INFORMATION: <br />Copies of the complete contract documents are on file with the Office of the City Clerk and are available <br />upon request. <br />FUNDING SOURCE: <br />Funds have been appropriated in Account No. 001-5-5391-446003-00000. <br />ATTACHMENTS: <br />Resolution <br />Fourth Amendment <br />Item Number: 10.1- <br />460 <br />
