In the following instances the employee will not qualify for Holiday Pay: <br /> <br />2.1. Employees who have taken unauthorized leave the day prior to or the day after a <br />holiday. <br />2.2 Employees who are on a Leave of Absence for 3 days or more the day before or after <br />the holiday. <br /> <br /> <br />3. MILITARY LEAVE OF ABSENCE <br /> <br /> 3.1 Military Leave: Employees who enter the military service will be granted a leave of <br />absence without pay in accordance with applicable federal and state laws. You will retain full <br />seniority benefits for all prior service upon re-employment, if after being discharged from the <br />service, you return within the time prescribed by federal regulations and have not worked any <br />intermittent jobs. Copies of military orders and other relevant information will be requested prior <br />to approval. If any of these provisions are inconsistent with applicable law, the Company will <br />fully comply with applicable law. <br /> <br /> 3.2. Annual Military Reserve Training: Employees who serve in U.S. military organizations or <br />state militia groups may take necessary time off without pay to fulfill this obligation, and will <br />retain all of their legal rights for continued employment under existing laws. These employees <br />may apply personal days and unused earned vacation time to the leave if they prefer, but are <br />not required to do so. You are expected to notify your manager and human resources <br />representatives as soon as you are notified of the dates you will be on duty so that arrangements <br />can be made for coverage during this absence. <br /> <br /> <br />4. BEREAVEMENT LEAVE <br /> <br />Regular full-time employees are granted leave of absence without pay for up to three days <br />within one calendar year because of death of a family member. Family members recognized <br />for this purpose are grandparents, parents, siblings, husband and wife, children, and <br />grandchildren. These three days are to be taken consecutively within a reasonable time of the <br />day of the death or the day of the funeral, and may not be split or postponed. <br /> <br /> <br />5. FAMILY AND MEDICAL LEAVE <br /> <br />In accordance to the provisions of the Family and Medical Leave Act of 1993, as amended, and <br />its implementing regulations (the "FMLA"), and current Company policy, an Eligible Employee is <br />entitled to unpaid family and medical leave, or military family leave as set forth below: <br /> <br />5.1. Definitions: <br /> <br />(a) Eligible Employees: Employees who have worked for the Company for at least <br />twelve (12) months, and have worked at least 1,250 hours during the 12 month period <br />immediately before the commencement of the leave, if employed at a job site where <br />there are 50 or more employees within a 75 mile radius. <br /> <br />(b) Covered Service member: A member of the Armed Forces, including a member of <br />the National Guard or Reserves, who is undergoing medical treatment, recuperation, or <br />15 <br /> <br /> <br />
