On May 29, 2024, Applicant submitted the 1g' Amended Letter of Intent (i) requesting the <br />granting of a variance from Code Sec. 265-71.0 ("Variance") to only be required to plant five (5) Date Palm <br />Trees in the northwest corner of the Property (the "Northwest Area") and requesting approval ofApplicant's <br />revised landscaping plan, showing only five (5) Date Palm Trees in the Northwest Area, and replacing the <br />overall landscape sheet within the Site Plan ("Site Plan Modification") and (ii) requesting the approval of <br />a modification to the Site Plan by which the condition to underground utility lines referenced in Section <br />V.13.21 of the Resolution is deleted ("Request to Cancel Undergrounding Condition'). <br />Applicant (i) respectfully withdraws its Request to Cancel Undergrounding Condition since the <br />utility lines referenced in the Resolution have already been removed by FP&L and (ii) respectfully re- <br />submits its request for the granting of the Variance under Code Sec. 265-71.0 and the approval of the Site <br />Plan Modification in order to not interfere with the water facilities and underground electric utility facilities <br />installed underground in the Northwest Area (collectively, " Undergro and Utilities") and to provide the City <br />of North Miami Beach and FP&L with the ability to maintain such Underground Utilities. <br />We look forward to your favorable review.
