EpdvTjho!Fowfmpqf!JE;!2193E418.88DB.5943.:22G.914D7G:28845EpdvTjho!Fowfmpqf!JE;!ED64EEGG.2G1:.5:C6.C4CB.73549671:658 <br />Cspxbse!Tifsjgg(t!PggjdfCje!2:142NGX <br />2.12Or Equal Clause.Whenever a material, article or piece of equipment is identified in the plans, <br />drawings, technical specifications, or other documents approved by the SHERIFF gives reference to <br />manufacturers' or vendors' names, trade names, catalog numbers, or otherwise, it is intended merely <br />to establish a standard, and unless it is followed by words indicating that no substitution is permitted, <br />any material, article or equipment of other manufacturers and vendors which will perform or serve <br />the requirements of the general design will be considered equally acceptable provided the material, <br />article or equipment so proposed is, in the opinion of the PROJECT MANAGER, equal in substance, <br />quality and function. All proposed substitution requests shall be made formally, in writing. Shop <br />drawings with substitutions be considered a formal request for <br />substitution unless accompanied by a letter requesting the change together with published <br />manufacturer technical literature (cut sheets) demonstrating the equality or superiority of the proposed <br />substitutionincluding warranty periods, product or assembly guarantees, et. al. including any cost <br />savings to SHERIFF by the substitution. The PROJECT MANAGER will be the sole judge of <br />acceptability and no substitute will be ordered, installed or utilized without prior written acceptance, <br />which will be evidenced by either a Change Order or approved shop drawing. SHERIFF may require <br />CONTRACTOR to furnish at its own expense a specialperformanceguaranteeorothersuretywith <br />respect toanysubstitute. <br />2.13CONTRACTOR shall provide to SHERIFF a One Hundred Percent (100%) performance and <br />payment bond, in a form approved by the Risk Management Division, executed by a <br />surety insurer registered to do business in the State of Florida, subject to the approval of the Secretary <br />of the State of Florida, to guarantee the faithful performance of this Agreement for eachproject <br />quotation awarded that requires a bond. This bond shall be kept in full force and effect throughout the <br />life of the project quotation awarded that the bond was issued for. The surety companymusthavea <br />bestratingofA-VIor <br />better. The amount of the required bond shall not exceed five percent (5%) of the reported policy <br />holders surplus as reported in the latest (1989 or later) edition of Best's Day rating Guide, <br />published by Alfred M. Best Company, Inc. All bonds must be in accordance with Section 255.05, <br />Florida Statutes <br />Further, each bond shall continue in effect for one (1) year after final completion and acceptance <br />of the work with liability equal to one hundred percent (100%) of the contract price stated herein, <br />or an additional bond shall be conditioned that CONTRACTOR will, upon notification by <br />SHERIFF, correct any defective or faulty work or materials whichappear within one (1) year after <br />final completion of this Agreement. Pursuant to the requirements of Section 255.05, Florida <br />Statutes, CONTRACTOR shall ensure that the bond(s) referenced above shall be recorded in the <br />public records of Broward County and provide SHERIFF with evidence of suchrecording. <br />2.14In addition to any other warranties required by this Agreement or other Agreement Documents, <br />CONTRACTOR warrants, except as otherwise provided herein, that work performed under this <br />Agreement conforms to the Agreement requirements, all materials are new, and are free of any <br />defects in equipment, material, or design furnished or workmanship performed by the <br />CONTRACTOR or any subcontractor or supplier at anytier. <br />2.14.1This warranty shall continue for a period of one (1) year from the date of final acceptance <br />of thework. <br />80370312:!22;67!BNq/!89 <br /> <br />
