EpdvTjho!Fowfmpqf!JE;!2193E418.88DB.5943.:22G.914D7G:28845EpdvTjho!Fowfmpqf!JE;!ED64EEGG.2G1:.5:C6.C4CB.73549671:658 <br />AGREEMENT <br />BY AND BETWEEN <br />SHERIFF OF BROWARD COUNTY, FLORIDA <br />AND <br />MBR CONSTRUCTION, INC. <br /> <br />FOR <br />PRE-QUALIFIED GENERAL CONTRACTOR <br /> <br />This is an Agreement, by and between SHERIFF OF BROWARD COUNTY, FLORIDA, hereinafter <br />referred to as "SHERIFF" and/or <br /> <br />AND <br /> <br />MBR CONSTRUCTION, INC., a Florida business entity, authorized and doing business in the State <br />of Florida, hereinafter referred to as "CONTRACTOR." <br /> <br />IN CONSIDERATION of the mutual terms, conditions, promises, covenants, and payments <br />hereinafter set forth, SHERIFF AND CONTRACTOR agree as follows: <br /> <br />All provisions of the RLI#19031MFW and any and all Addenda are incorporated into this Agreement as if <br />written word for word. The terms and conditions of this Agreement shall be incorporated into the project <br />quotations as if written word for word. <br /> <br />If the parties have a current general contracting agreement in place by and between themselves, then that <br />agreement and its terms and conditions shall continue to apply to the construction job or services or <br />projects commenced before January 1, 2020. After January 1, 2020, any new construction jobs or <br />services or projects shall be governed under this Agreement. <br /> <br />ARTICLE 1 - DEFINITIONS <br /> <br />For the purposes of this Agreement and the various covenants, conditions, terms, and provisions that follow, <br />the definitions and identifications set forth below are assumed to be true and correct and are agreed upon <br />by the parties. <br /> <br />1.1!Beneficial Occupancy. A milestone in the progress of the Project where work has proceeded <br />to a point such that SHERIFF can occupy and make beneficial use of the facilities, and <br /> <br />2 <br /> <br />
