Upon request, CONTRACTOR shall provide a <br />notarized affidavit to the PROJECT MANAGER that all motor vehicles which will be operated <br />in Florida are registered in compliance with Ch. 320, F.S. <br /> <br />2.10!Utilities: It shall be CONTRACTOR's responsibility to identify and preserve all existing <br />utilities. If utility conflicts are encountered by CONTRACTOR during construction, <br />CONTRACTOR shall give sufficient notice to the utility's owner so that they may make <br />the necessary adjustments. Damage to any utility, which in the opinion of the SHERIFF is <br />caused by carelessness on the part of CONTRACTOR, shall be repaired at <br />CONTRACTOR's expense. <br /> <br />2.11!CONTRACTOR shall arrange for and comply with all inspections required by local, state, <br />and federal agencies. The PROJECT MANAGER shall at all times have access to the <br />Project and CONTRACTOR shall provide proper facilities for such access. <br /> <br />2.12!Or Equal Clause. Whenever a material, article or piece of equipment is identified in the plans, <br />drawings, technical specifications, or other documents approved by the SHERIFF gives <br />reference to manufacturers' or vendors' names, trade names, catalog numbers, or otherwise, it <br />is intended merely to establish a standard, and unless it is followed by words indicating that <br />no substitution is permitted, any material, article or equipment of other manufacturers and <br />vendors which will perform or serve the requirements of the general design will be considered <br />equally acceptable provided the material, article or equipment so proposed is, in the opinion <br />of the PROJECT MANAGER, equal in substance, quality and function. All proposed <br />substitution requests shall be made formally, in writing. Shop drawings with substitutions <br />included as shall not be considered a formal request for substitution unless <br />accompanied by a letter requesting the change together with published manufacturer technical <br />literature (cut sheets) demonstrating the equality or superiority of the proposed substitution <br />including warranty periods, product or assembly guarantees, et. al. including any cost savings <br />to SHERIFF by the substitution. The PROJECT MANAGER will be the sole judge of <br />acceptability and no substitute will be ordered, installed or utilized without prior written <br />acceptance, which will be evidenced by either a Change Order or approved shop drawing. <br />SHERIFF may require CONTRACTOR to furnish at its own expense a special performance <br />guarantee or other surety with respect to any substitute. <br /> <br />2.13!CONTRACTOR shall provide to SHERIFF a One Hundred Percent (100%) performance and <br />payment bond, in a form approved by the Risk Management Division, executed <br />by a surety insurer registered to do business in the State of Florida, subject to the approval of <br />the Secretary of the State of Florida, to guarantee the faithful performance of this Agreement <br />for each project quotation awarded that requires a bond. This bond shall be kept in full force <br />and effect throughout the life of the project quotation awarded that the bond was issued for. <br />The surety company must have a best rating of A-VI or better. The amount of the required <br />bond shall not exceed five percent (5%) of the reported policyholders surplus as reported <br />in the latest (1989 or later) edition of Best's Day rating <br /> <br />7 <br /> <br />
