therapy, is otherwise in outpatient status, or is otherwise on the temporary disability retired <br />list, for a serious injury or illness incurred in the line of duty on active duty. <br />(c)Covered Military Member: The employee's spouse, son, daughter or parent who is a <br />member of the reserve components or a retired member of the Regular Armed Forces or <br />Reserve, and who is on active duty or call to active duty status. <br />(d)Next of Kin: The nearest blood relative (in order of priority under the FMLA or as <br />designated by the Covered Servicemember) of a Covered Servicemember other than <br />the Covered Servicemember's spouse, parent, son or daughter for purposes of Caregiver <br />Leave as specified under the FMLA. <br />(e)Outpatient Status: With respect to a Covered Servicemember, the status of a <br />member of the Armed Forces assigned to either a military medical treatment facility as <br />an outpatient; or a unit established for the purpose of providing command and control <br />of members of the Armed Forces receiving medical care as outpatients. <br />(f)Serious Injury or Illness: Any injury or illness incurred by a Covered Servicemember in <br />the line of duty on active duty that may render the servicemember medically unfit to <br />perform the duties of the servicemember's office, grade, rank, or rating. <br />(g)Serious Health Condition: An injury, illness, impairment, or physical or mental <br />condition that involves inpatient care or continuing treatment by a health care provider. <br />5.2.Reasons for Leave:All employees of the Company are directed to review the <br />Department of Labor Notice to Employees referenced as "Employee Rights and Responsibilities <br />underthe Family and Medical Leave Act" (WHD Publication 1420).Please Note that all <br />employees may at any time during regular Company hours obtain copies of the forms <br />referenced herein from the Human Resources Representative. Further, employees with questions <br />or complaints regarding the FMLA should contact the Human Resources Representative.In <br />accordance with applicable regulations and the FMLA, as amended, the Company provides <br />the following types of FMLA leave: <br />(a)Basic Leave: Eligible Employees will be granted a total of up to 12 weeks of unpaid <br />leave for the followingreasons: <br />(i)the birth of the employee's child and in order to care for that child; <br />(ii)the placement of a child with the employee for adoption or foster care, and to <br />care for the newly placed child; <br />(iii)the care for a spouse, child, or parent (not parents "in law") who has a serious <br />health condition; or <br />(iv)the employee's own serious health condition that renders the employee unable <br />to perform one or more of the essential functions of his or her job. <br />(b)Qualifying Exigency Leave: Eligible Employees with a Covered Military Member may <br />use their 12-week leave entitlement to address certain "qualifying exigencies." Qualifying <br />exigencies include short notice deployments (7 or fewer days), military events and <br />related activities, arranging for alternative childcare, addressing certain financial and <br />legal arrangements, attending certain counseling sessions, rest and recuperation <br />attending post-deployment reintegration briefings, and additional activities as agreed to <br />by the Company and the employee.
