STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION <br />AMENDMENT TO LEASE AGREEMENT <br />ITEM/SEGMENT NO.: <br />2488311 <br />MANAGING DISTRICT: <br />Six <br />F.A.P. NO.: <br />NIA <br />STATE ROAD NO.: <br />AIA & 856 <br />COUNTY: <br />Miami -Dade <br />PARCEL NOS.: <br />653 (Lot 3) & <br />654 (Lots 1 & 2) <br />THIS AMENDMENT ("Amendment") made effective this day of , 2024 <br />("Effective Date") is an amendment to that certain Lease Agreement ("Lease") between the <br />STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION, ("Department" or "Lessor"), and <br />CITY OF SUNNY ISLES BEACH, Florida Municipal Corporation, of 18070 Collins Avenue, <br />Sunny Isle, Florida 33160, ("Lessee" or "City") (collectively, the "Parties"). <br />RECITALS <br />WHEREAS, on May 5, 2021, the Parties entered into a Lease for Parcels 653 and 654; <br />and <br />WHEREAS, the Parties desire to amend certain terms of the Lease, including, but not <br />limited to, WHEREAS, the Parties also desire to terminate the Lease as to Parcel 653 only and <br />to enter into new agreement for the lease of Parcel 653 to the City; and <br />WHEREAS, except as modified in this Amendment, the Lease remains in full force and <br />effect as to Parcel 654 only, <br />NOW THEREFORE, in consideration of the mutual covenants and promises contained in <br />this Amendment, and for other good and valuable consideration the receipt and sufficiency of <br />which are acknowledged by the Parties, the Parties agree to amend the Lease in the following <br />manner. <br />AGREEMENT <br />1. The foregoing recitals are hereby adopted and incorporated herein to the Lease. <br />2. As of the Effective Date, the Lease is terminated as to Parcel 653 only. <br />3. Paragraph 2, Use, is deleted in its entirety and is replaced with the following: <br />a. Parcel 654 (the "Leased Property") shall be used solely for the following purposes: <br />Public parking for fee for the general public. The City shall prohibit overnight, <br />camping, and sleeping, and cooking in vehicles parked in the Leased Property. <br />1 of 4 <br />536 <br />
