STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION AMENDMENT TO LEASE AGREEMENT ITEM/SEGMENT NO.: 2488311 MANAGING DISTRICT: Six F.A.P. NO.: NIA STATE ROAD NO.: AIA & 856 COUNTY: Miami -Dade PARCEL NOS.: 653 (Lot 3) & 654 (Lots 1 & 2) THIS AMENDMENT ("Amendment") made effective this day of , 2024 ("Effective Date") is an amendment to that certain Lease Agreement ("Lease") between the STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION, ("Department" or "Lessor"), and CITY OF SUNNY ISLES BEACH, Florida Municipal Corporation, of 18070 Collins Avenue, Sunny Isle, Florida 33160, ("Lessee" or "City") (collectively, the "Parties"). RECITALS WHEREAS, on May 5, 2021, the Parties entered into a Lease for Parcels 653 and 654; and WHEREAS, the Parties desire to amend certain terms of the Lease, including, but not limited to, WHEREAS, the Parties also desire to terminate the Lease as to Parcel 653 only and to enter into new agreement for the lease of Parcel 653 to the City; and WHEREAS, except as modified in this Amendment, the Lease remains in full force and effect as to Parcel 654 only, NOW THEREFORE, in consideration of the mutual covenants and promises contained in this Amendment, and for other good and valuable consideration the receipt and sufficiency of which are acknowledged by the Parties, the Parties agree to amend the Lease in the following manner. AGREEMENT 1. The foregoing recitals are hereby adopted and incorporated herein to the Lease. 2. As of the Effective Date, the Lease is terminated as to Parcel 653 only. 3. Paragraph 2, Use, is deleted in its entirety and is replaced with the following: a. Parcel 654 (the "Leased Property") shall be used solely for the following purposes: Public parking for fee for the general public. The City shall prohibit overnight, camping, and sleeping, and cooking in vehicles parked in the Leased Property. 1 of 4 536
