Lessee's Public Works storage area of the following: equipment and materials <br />typical to the support and maintenance of roads and infrastructure such as <br />trucks, buses, street sweepers, bucket trucks, bobcats, pavers, sand, wood, <br />street pole lights, signs and sign posts, spare parts for bus shelters, tools, <br />shovels, parts for lifeguard stand repairs, spare mulch, marine patrol boat <br />trailers, and so forth. <br />iii. Basketball court for public use at no charge to the public. Lessee shall notify <br />the Department in writing of its intent to begin charging the public for the use of <br />the basketball court. <br />iv. Trap -Neuter -Release ("TNR") holding area: Lessee shall also be responsible <br />for pursuing all applicable permits and licenses from all other government <br />agencies and permitting authorities for TNR to be performed within the Leased <br />Property. Lessee shall not construe this Lease as a specific permit or <br />authorization for construction of any improvements. The TNR shall be subject <br />to the following conditions: <br />(1) No neutering/spaying activity is allowed on the Leased Property. <br />(2) Only the City's authorized volunteers for the City's TNR Program may <br />use the Leased Property for TNR purposes and have access to the <br />designated TNR area within the Leased Property. <br />(3) Cats that have been spayed or neutered are to be kept at the <br />designated TNR area within the Leased Property in crates during the <br />healing period of 24-48 hours post-surgery. <br />(4) Cats are to be released back to where they were trapped. <br />Notwithstanding, in no event shall any cats be released on the Leased <br />Property. <br />(5) TNR area is to be used only on an as -needed basis. <br />If the Leased Property is used for any other purpose, Lessor shall have the option of <br />immediately terminating this Lease. Lessee shall not permit any use of the Leased <br />Property in any manner that would obstruct or interfere with any transportation facilities. <br />Lessee will further use and occupy the Leased Property in a careful and proper manner, <br />and not commit any waste thereon. Lessee will not cause, or allow to be caused, any <br />nuisance or objectionable activity of any nature on the Leased Property. Lessee will not <br />use or occupy said Leased Property for any unlawful purpose and will, at Lessee's sole <br />cost and expense, conform to and obey any present or future ordinances and/or rules, <br />regulations, requirements, and orders of governmental authorities or agencies respecting <br />the use and occupation of the Leased Property. <br />2 of 4 <br />537 <br />
