<br />22 <br /> RFP 24-12-01 CITYWIDE ELEVATOR MAINTENANCE <br />CITY OF SUNNY ISLES BEACH <br />18070 Collins Ave. | Sunny Isles Beach, FL 33160 <br />305.792.1707 | sibfl.net | Purchasing@sibfl.net <br />may enter into an agreement with the secondary contractor to perform such work and charge the <br />total cost to the Contractor. <br /> <br />3.1.3 Materials Included in Services: <br /> <br />Services shall include all materials. <br /> <br />The term “materials” shall include all tangible property, whether designated as materials, goods, <br />parts or otherwise. <br /> <br />All such materials shall be as follows: <br /> <br />• New, as specified herein. <br /> <br />• Good quality and suitable for their intended use. Utilize original equipment, <br />manufacturers’ materials, or approved equal goods or parts, for all renewal, <br />replacement, repair, and lubrication procedures. <br /> <br /> <br />• It shall be the Elevator Contractor’s responsibility to obtain and provide proof of <br />obsolescence to the owners when a part cannot be found from an original elevator <br />manufacturer or from any qualified third-party or after-market supplier. The Elevator <br />Contractor cannot label or claim a component is obsolete and charge for replacement <br />of that component in lieu of repairing or replacing that component under the <br />maintenance Agreement. A change in component part(s) that are interchangeable in <br />form, fit, and function shall be considered a replacement part and as such are covered <br />and included under this specification. <br /> <br />3.2 EQUAL PRODUCT: <br /> <br /> Manufacturer’s brand name and model number are used in these specifications for the purpose <br /> of establishing minimum requirement level of quality and standards of performance and design <br /> required. This is in no way intended to prohibit the proposing of other manufacturer’s items of <br /> equal material and function, unless otherwise indicated. Equal (substitution) may be bid, <br /> providing the product bid is found to be equal in quality, standards of performance, design, etc. <br /> to item specified, unless otherwise indicated. Where equal is proposed, bid must be accompanied <br /> by complete factory information sheets (specifications, brochures, etc.) documenting the <br /> equipment bid as equal. The CITY, after evaluation of the documentation submitted, will <br /> determine if products is approved as equal to the specified request. <br /> <br />3.3 MATERIALS AND PARTS COSTS: <br /> <br />• The cost for any materials, and parts not specified herein furnished by the Contractor shall be <br />based on the Contractor’s wholesale price and billed at the Contractor's cost, plus proposed <br />mark-up fee. Markup on sales tax is not permitted. A copy of the parts and materials invoice <br />shall be submitted with the Contractors invoice. <br />• The City reserves the right to review Contractor's records to verify the charges for any parts
