<br />AGREEMENT BETWEEN THE CITY OF SUNNY ISLES BEACH
<br />AND _PAUL O'CONNELL, d/b/a POLICING WITH PASSION. LLC
<br />THIS CONTRACTUAL AGREEMENT (hereinafter referred to as the "Agreement') is
<br />-made in duplicate, this ,_ day of March, 2024, by and between the CITY OF SUNNY ISLES
<br />BEACH, Florida, (hereinafter referred to as "City"), and PAUL O'CONNELL, d/b/a
<br />POLICING WITH PASSION, LLC, a Florida limited liability company (hereinafter referred to
<br />as "Consultant"), whose Federal I.D. # is 82-3529569.
<br />RECITALS
<br />WHEREAS, the City is in need of Consultant to provide general professional law
<br />enforcement consulting services, including but not limited to, oversight of the City's Red
<br />Light Camera Program under the Mark Wandell Traffic Safety Program, Section 316.0083,
<br />Florida Statutes, and to serve as an alternate Traffic Infraction Enforcement Officer, on an as -
<br />needed basis ("Services'); and
<br />WHEREAS, Consultant has the necessary experience to provide the desired Services, and
<br />meets the qualifications for a Traffic Infraction Enforcement Officer pursuant to Section
<br />316.640(l)(b)(3), Florida Statutes; and
<br />WHEREAS, pursuant to Section 62-13(B) the City's procurement code, contracts for
<br />professional services are exempt from the City's competitive bidding procedures; and
<br />WHEREAS, the City wishes to contract with Consultant to provide the desired
<br />professional Services and shall pay Consultant at a rate of Four Thousand Dollars and No Cents
<br />($4,000,00) per month, for a total not -to -exceed contract amount of Forty -Eight Thousand Dollars
<br />and No Cents ($48,000.00);
<br />NOW THEREFORE, in consideration of the promises and the mutual covenants herein
<br />name, the parties agree as follows:
<br />TERMS
<br />1. RECITALS. The Recitals set forth above are hereby incorporated into this Agreement
<br />and made a part hereof for reference.
<br />2. SERVICES. Consultant shall provide general professional law enforcement
<br />consulting services, including but not limited to, the oversight of the City's Red Light Camera
<br />Program under the Mark Wandell Traffic Safety Program, Section 316.0083, Florida Statutes,
<br />and to serve as an alternate Traffic Inftaction Enforcement Officer, on an as -needed basis. The
<br />City shall provide the Consultant all necessary equipment (laptop, office supplies, etc.), onsite
<br />internet access connections and access to the City's computer network system, state vehicle
<br />registration system, Miami -Dade Court system, traffic infraction forms, Notice of Violation forms,
<br />for purposes of Contractor complying with the requirements ofFlorida Statutes, including Section
<br />316.0083, Florida Statutes. Consultant agrees to adhere to all policies, procedures, and/or user
<br />and license agreements regarding use of, and access to, the foregoing City computer network as
<br />well as any third -party databases and services. Contractor agrees that he shall maintain all
<br />certifications and credentials required by Florida Statutes to perform the duties of a Traffic
<br />Infraction Enforcement Officer
