ENROLLED <br />2025 Legislature <br />SB 2-C <br />20252Cer <br />378 felony of the third degree. <br />379 (3)-( A felony of the third degree is reclassified to a <br />380 felony of the second degree. <br />381 (4)+2+ A felony of the second degree is reclassified to a <br />382 felony of the first degree. <br />383 (5)4-3+ A felony of the first degree is reclassified to a <br />384 life felony. <br />385 Section 11. Subsection (1) of section 874.03, Florida <br />386 Statutes, is amended, and subsection (8) is added to that <br />387 section, to read: <br />388 874.03 Definitions.—As used in this chapter: <br />389 (1) "Criminal gang" means a formal or informal ongoing <br />390 organization, association, or group that has as one of its <br />391 primary activities the commission of criminal or delinquent <br />392 acts, and that consists of three or more persons who have a <br />393 common name or common identifying signs, colors, or symbols, <br />394 including, but not limited to, terrorist organizations, <br />395 transnational crime organizations, and hate groups. <br />396 (a) As used in this subsection, "ongoing" means that the <br />397 organization was in existence during the time period charged in <br />398 a petition, information, indictment, or action for civil <br />399 injunctive relief. <br />400 (b) As used in this subsection, "primary activities" means <br />401 that a criminal gang spends a substantial amount of time engaged <br />402 in such activity, although such activity need not be the only, <br />403 or even the most important, activity in which the criminal gang <br />404 engages. <br />405 (8) "Transnational crime organization" means any group, <br />406 network, or association of persons, at least one of which is an <br />Page 14 of 51 <br />CODING: Words stLcieken are deletions; words underlined are additions. 247 <br />
