ENROLLED <br />2025 Legislature <br />SB 2-C <br />20252Cer <br />523 903.046, Florida Statutes, is amended to read: <br />524 903.046 Purpose of and criteria for bail determination. - <br />525 (2) When determining whether to release a defendant on bail <br />526 or other conditions, and what that bail or those conditions may <br />527 be, the court shall consider: <br />528 (c) The defendant's family ties, length of residence in the <br />529 community, immigration status, employment history, financial <br />530 resources, and mental condition. <br />531 Section 14. Subsections (1) and (3) and paragraph (e) of <br />532 subsection (5) of section 907.041, Florida Statutes, are <br />533 amended, subsection (6) is added to that section, and paragraph <br />534 (a) of subsection (5) of that section is republished, to read: <br />535 907.041 Pretrial detention and release. - <br />536 (1) LEGISLATIVE INTENT. -It is the policy of this state that <br />537 persons committing serious criminal offenses, posing a threat to <br />538 the safety of the community or the integrity of the judicial <br />539 process, e -r- failing to appear at trial, or posing a substantial <br />540 flight risk because of their status as unauthorized aliens be <br />541 detained upon arrest. However, persons found to meet specified <br />542 criteria shall be released under certain conditions until <br />543 proceedings are concluded and adjudication has been determined. <br />544 The Legislature finds that this policy of pretrial detention and <br />545 release will assure the detention of those persons posing a <br />546 threat to society while reducing the costs for incarceration by <br />547 releasing, until trial, those persons not considered a danger to <br />548 the community who meet certain criteria.
