ENROLLED <br />2025 Legislature <br />SB 2-C <br />20252Cer <br />552 (a) It is the intent of the Legislature to create a <br />553 presumption in favor of release on nonmonetary conditions for <br />554 any person who is granted pretrial release unless such person is <br />555 charged with a dangerous crime as defined in subsection (5) or <br />556 such person is an unauthorized alien charged with a forcible <br />557 felony as described in subsection (6). A Si:ieh person charged <br />558 with a dangerous crime as defined in subsection (5) shall be <br />559 released on monetary conditions if it is determined that such <br />560 monetary conditions are necessary to assure the presence of the <br />561 person at trial or at other proceedings, to protect the <br />562 community from risk of physical harm to persons, to assure the <br />563 presence of the accused at trial, or to assure the integrity of <br />564 the judicial process. <br />565 (b) No person shall be released on nonmonetary conditions <br />566 under the supervision of a pretrial release service, unless the <br />567 service certifies to the court that it has investigated or <br />568 otherwise verified: <br />569 1. The circumstances of the accused's family, employment, <br />570 financial resources, character, mental condition, immigration <br />571 status, and length of residence in the community; <br />572 2. The accused's record of convictions, of appearances at <br />573 court proceedings, of flight to avoid prosecution, or of failure <br />574 to appear at court proceedings; and <br />575 3. Other facts necessary to assist the court in its <br />576 determination of the indigency of the accused and whether she or <br />577 he should be released under the supervision of the service. <br />578 (5) PRETRIAL DETENTION. - <br />579 (a) As used in this subsection, "dangerous crime" means any <br />580 of the following: <br />Page 20 of 51 <br />CODING: Words men are deletions; words underlined are additions. 253 <br />
