The defendant may rebut the <br />presumption by demonstrating, by a preponderance of the <br />evidence, that appropriate conditions of release will ensure his <br />or her appearance at trial. If the court determines the <br />defendant has rebutted the presumption, it must consider the <br />criteria in s. 903.046, and any other relevant facts, to <br />determine whether to.release the defendant on bail or other <br />conditions. <br />(d) The defendant may request a continuance of his or her <br />first appearance hearing conducted under this subsection. A <br />continuance shall not be longer than 48 hours unless the court <br />determines there are extenuating circumstances. The state <br />attornev shall be entitled to one continuance for aood cause. <br />The defendant may not be released from custodv pendina anv such <br />continuance. <br />Section 15. Paragraphs (e) and (f) of subsection (6) of <br />section 908.102, Florida Statutes, are amended, and paragraphs <br />(g) and (h) are added to that subsection, to read: <br />908.102 Definitions.—As used in this chapter, the term: <br />(6) "Sanctuary policy" means a law, policy, practice, <br />procedure, or custom adopted or allowed by a state entity or <br />local governmental entity which prohibits or impedes a law <br />enforcement agency from complying with 8 U.S.C. s. 1373 or which <br />prohibits or impedes a law enforcement agency from communicating <br />or cooperating with a federal immigration agency so as to limit <br />Page 23 of 51 <br />CODING: Words1�en are deletions; words underlined are additions. 256 <br />
