ENROLLED <br />2025 Legislature <br />SB 2-C <br />20252Cer <br />929 sheriff or chief correctional officer operating a county <br />930 detention facility must provide the requesting federal <br />931 immigration agency a list of all inmates booked into a county <br />932 detention facility and any information regarding each inmate's <br />933 immigration status. <br />934 (7)+&* This section does not require a state entity, local <br />935 governmental entity, or law enforcement agency to provide a <br />936 federal immigration agency with information related to a victim <br />937 of or a witness to a criminal offense if: <br />938 (a) The victim or witness is necessary to the investigation <br />939 or prosecution of a crime, and such crime occurred in the United <br />940 States; and <br />941 (b) The victim or witness timely and in good faith responds <br />942 to the entity's or agency's request for information and <br />943 cooperates eeepeLaatlen in the investigation or prosecution of <br />944 such the offense. <br />945 (8)-F-&- A state entity, local governmental entity, or law <br />946 enforcement agency that, pursuant to subsection (7) +B+, <br />947 withholds information regarding the immigration information of a <br />948 victim of or witness to a criminal offense shall document the <br />949 victim's or witness's cooperation in the entity's or agency's <br />950 investigative records related to the offense and shall retain <br />951 the records for at least 10 years for the purpose of audit, <br />952 verification, or inspection by the Auditor General. <br />953 (10)x-8-}- This section does not apply to any alien unlawfully <br />954 present in the United States if he or she is or has been a <br />955 necessary witness or victim of a crime of domestic violence, <br />956 rape, sexual exploitation, sexual assault, murder, manslaughter, <br />957 assault, battery, human trafficking, kidnapping, false <br />Page 33 of 51 <br />CODING: Words stLcieleen are deletions; words underlined are additions. 266 <br />
