ENROLLED <br />2025 Legislature SB 2-C <br />20252Cer <br />117 104.155 Unqualified noncitizen electors willfully voting; <br />118 prohibited defenses; aiding or soliciting noncitizen electors in <br />119 voting prohibited. - <br />120 (1) Any person who is not a qualified elector because he or <br />121 she is not a citizen of the United States and who willfully <br />122 votes in any election is guilty of a felony of the third degree, <br />123 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. <br />124 A person's ignorance of his or her citizenship status or a <br />125 person's bona fide belief of his or her citizenship status <br />126 cannot be raised as a defense in a prosecution for a violation <br />127 of this subsection. <br />128 (2) Any person who aids or solicits another to violate <br />129 subsection (1) with knowledge that such person is not a citizen <br />130 of the United States is guilty of a felony of the third degree, <br />131 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. <br />132 Section 2. Subsection (13) is added to section 319.001, <br />133 Florida Statutes, to read: <br />134 319.001 Definitions.—As used in this chapter, the term: <br />135 (13) "Valid passport" means: <br />136 (a) An unexpired passport or passport card issued by the <br />137 United States government; or <br />138 (b) An unexpired passport issued by the government of <br />139 another country with: <br />140 1. A stamp or mark affixed by the Federal Government onto <br />141 the passport to evidence and authorize lawful presence in the <br />142 United States; or <br />143 2. An unexpired I-94, or current permanent resident card, <br />144 or unexpired immigrant visa, issued by the Federal Government. <br />145 Section 3.
