BROKER'S COMMISSIONS. LESSEE and LESSORS represent and warrant to each <br />other that neither of them have dealt with any real estate broker, finder or other person, with respect to <br />this Lease in any manner, except the Colliers International and Avenue Real Estate Partners who will <br />be compensated by LESSOR. Each party shall indemnify and hold the other harmless from any and all <br />damages resulting from claims that may be asserted against either party by any other broker, finder or <br />other person (including, without limitation, any substitute or replacement broker claiming to have been <br />engaged by a party in the future), claiming to have dealt with a party in connection with this Lease or <br />any amendment or extension hereto. The provisions of this paragraph shall survive the termination of <br />this Lease. Excluded from the LESSOR's indemnification obligations in this Section are any claims for <br />which the LESSOR, as a municipality, is immune from suit under the doctrine of sovereign immunity <br />or for any amount of a claim exceeding the limitations of liability established by Section 768.28, Florida <br />Statutes. <br />34. ENVIRONMENTAL COMPLIANCE. <br />34.1. LESSEE's Responsibility. LESSEE shall not (either with or without negligence) <br />cause or permit the escape, disposal or release of any biologically active or other hazardous substances, <br />or materials. LESSEE shall not allow the storage or use of such substances or materials in any manner <br />not sanctioned by law or in compliance with the highest standards prevailing in the industry for the <br />storage and use of such substances or materials, nor allow to be brought into the Property or Leased <br />Premises any such materials or substances except to use in the ordinary course of LESSEE's business, <br />and then only after written notice is given to LESSOR of the identity of such substances or materials. <br />LESSEE covenants and agrees that the Leased Premises will at all times during its use or occupancy <br />thereof be kept and maintained so as to comply with all now existing or hereafter enacted or issued <br />statutes, laws, rules, ordinances, orders, permits and regulations of all state, federal, local and other <br />governmental and regulatory authorities, agencies and bodies applicable to the Leased Premises, <br />pertaining to environmental matters or regulating, prohibiting or otherwise having to do with asbestos <br />and all other toxic, radioactive, or hazardous wastes or material including, but not limited to, the Federal <br />Clean Air Act, the Federal Water Pollution Control Act, and the Comprehensive Environmental <br />Response, Compensation, and Liability Act of 1980, as from time to time amended (all hereafter <br />collectively called "Laws"). LESSEE shall execute affidavits, representations and the like, from time to <br />time, at LESSOR's request, concerning LESSEE's best knowledge and belief regarding the presence of <br />hazardous substances or materials on the Leased Premises. <br />34.2.
