In a tort action brought against 1153 <br />such subcontractor or employee, net economic damages shall be 1154 <br />limited to $2 million per liability claim and $200,000 per 1155 <br />automobile claim, including, but not limited to, past and future 1156 <br />medical expenses, wage loss, and loss of earning capacity, 1157 <br />offset by any collateral source payment paid or payable. In a 1158 <br />tort action brought against such subcontractor, noneconomic 1159 <br />damages shall be limited to $400,000 per claim. A claims bill 1160 <br />may be brought on behalf of a claimant pursuant to s. 768.28 for 1161 <br />any amount exceeding the limits specified in this paragraph. Any 1162 <br />offset of collateral source payments made as of the date of the 1163 <br />settlement or judgment shall be in accordance with s. 768.76. 1164 <br /> Section 29. For the purpose of incorporating the amendment 1165 <br />made by this act to section 768.28, Florida Statutes, in a 1166 <br />reference thereto, subsection (8) of section 420.504, Florida 1167 <br />Statutes, is reenacted to read: 1168 <br /> 420.504 Public corporation; creation, membership, terms, 1169 <br />expenses.— 1170 <br /> (8) The corporation is a corporation primarily acting as 1171 <br />an instrumentality of the state, within the meaning of s. 1172 <br />768.28. 1173 <br /> Section 30.
