Agents or employees of the 1476 <br />corporation, members of the board of directors of the 1477 <br />corporation, or representatives of the Division of Florida 1478 <br />Condominiums, Timeshares, and Mobile Homes shall be considered 1479 <br />officers, employees, or agents of the state, and actions against 1480 <br />them and the corporation shall be governed by s. 768.28. 1481 <br /> Section 43. For the purpose of incorporating the amendment 1482 <br />made by this act to section 768.28, Florida Statutes, in a 1483 <br />reference thereto, subsection (5) of section 760.11, Florida 1484 <br />Statutes, is reenacted to read: 1485 <br /> 760.11 Administrative and civil remedies; construction.— 1486 <br /> (5) In any civil action brought under this section, the 1487 <br />court may issue an order prohibiting the discriminatory practice 1488 <br />and providing affirmative relief from the effects of the 1489 <br />practice, including back pay. The court may also award 1490 <br />compensatory damages, including, but not limited to, damages for 1491 <br />mental anguish, loss of dignity, and any other intangible 1492 <br />injuries, and punitive damages. The provisions of ss. 768.72 and 1493 <br />768.73 do not apply to this section. The judgment for the total 1494 <br />amount of punitive damages awarded under this section to an 1495 <br />aggrieved person shall not exceed $100,000. In any action or 1496 <br />proceeding under this subsection, the court, in its discretion, 1497 <br />may allow the prevailing party a reasonable attorney's fee as 1498 <br />part of the costs.
