<br />ITB 24-06-02 CITYWIDE LANDSCAPING SERVICES 15 <br /> <br />CITY OF SUNNY ISLES BEACH <br />18070 Collins Ave. | Sunny Isles Beach, FL 33160 <br />305.792.1707 | sibfl.net | Purchasing@sibfl.net <br />2.4 NON-MANDATORY PRE-BID CONFERENCE <br />A pre-bid conference is scheduled for the time and location shown in the Notice to Bidder, <br />Thursday, July 11, 2024 at 11:00 AM Eastern Time (US and Canada). It is recommended that all <br />Bidders attend the online pre-bid conference. No claim of ignorance by the Bidder of conditions <br />that exist, or that may hereinafter exist as a result of failure to make the necessary examinations <br />or investigations or failure to fulfill in every detail the requirements of the contract documents, <br />will be accepted as basis for varying the requirements of the City of Sunny Isles Beach. Oral <br />statements may not be relied upon and will not be binding or legally effective. As such an <br />addendum will be issued if any alterations are made to the specifications contained herein. <br /> <br />2.5 TERM <br /> <br />This contract will commence upon execution by both parties which shall be effective succeeding <br />approval of the contract by the City Commission, or designee, unless otherwise stipulated in the <br />Notice of Award letter; and contingent upon the completion and submittal of all required proposal <br />documents. This contract shall remain in effect for an initial two (2) years, with the intent to <br />commence on November 1, 2024; provided that the services rendered by the Bidder during the <br />contract period are satisfactory. <br /> <br />2.5.1 Contract Extension: It is hereby agreed and understood that this contract may be extended <br />for an additional thirty (30) day transitional period after the stated expiration date of the contract <br />including any contract extensions exercised under the initially established option period terms of <br />the contract. During this transitional period the Bidder agrees to continue the same or a reduced <br />level (if such reduction is mutually agreed to and appropriately documented) of service to the City <br />at the same prices while the new contract, also in force, is being mobilized. If the Bidder is <br />supplying equipment in conjunction with this contract, the Bidder agrees to retain the equipment <br />at the designated City premise for an additional thirty (30) calendar days after the current <br />expiration of the Contract, at which time the equipment shall be removed from the premises. <br /> <br />2.6 OPTIONS TO RENEW <br /> <br />Prior to, or upon completion of that initial term, the City shall have the option at its sole discretion <br />to renew this contract for three (3) additional one-year renewal terms. Prior to completion of <br />each exercised contract term, the City may consider an adjustment to price based on changes in <br />the following pricing index: Consumer Price Index for Urban Wage Earners and Clerical Workers <br />(CPI-W): Miami-Fort Lauderdale, FL. <br /> <br />It is the Bidder’s responsibility to request any pricing adjustment under this provision, which shall <br />not exceed 5%. For any adjustment to commence on the first day of any exercised option period, <br />the Bidder’s request for adjustment shall be submitted no later than ninety (90) days prior to <br />expiration of the then current contract term. In no event will the price be increased or decreased <br />by a percentage greater than the percentage change reflected in the C.P.I. as published by the <br />U.S. Department of Labor. If no adjustment request is received from the Bidder, the City will <br />assume that the Bidder has agreed the optional term may be exercised without pricing <br />adjustment. Any adjustment request received after the commencement of a new option period <br />may not be considered. <br />The City reserves the right to negotiate lower pricing for the additional term(s) based on market
