<br />one of the successful bidders (primary, secondary or tertiary) are deemed to be performing
<br />unsatisfactorily as determined by the City, the City may opt to award their designated bid group
<br />to the Bidder performing to City’s approval.
<br />
<br />2.9 MINORITY / WOMEN’S / LABOR SURPLUS FIRMS PARTICIPATION:
<br />
<br />The City of Sunny Isles Beach, in accordance with the requirements as stated in C.F.R. 200.321
<br />encourages the active participation of minority businesses, women’s business enterprises and
<br />labor surplus area firms as a part of any subsequent agreement whenever possible. If subcontracts
<br />are to be let, through a prime contractor, that contractor is required to take the affirmative steps
<br />listed in items (1) through (6) below:
<br />(1) Placing qualified small and minority businesses and women's business enterprises on
<br />solicitation lists;
<br />
<br />(2) Assuring that small and minority businesses, and women's business enterprises are solicited
<br />whenever they are potential sources;
<br />
<br />(3) Dividing total requirements, when economically feasible, into smaller tasks or quantities to
<br />permit maximum participation by small and minority businesses, and women's business
<br />enterprises;
<br />
<br />(4) Establishing delivery schedules, where the requirement permits, which encourage
<br />participation by small and minority businesses, and women's business enterprises;
<br />
<br />(5) Using the services and assistance, as appropriate, of such organizations as the Small Business
<br />Administration and the Minority Business Development Agency of the Department of Commerce.

<br />(6) Requiring the prime contractor, if subcontracts are to be let, to take the affirmative steps listed
<br />in paragraphs (1) through (5) of this section.

<br />2.10 NON-DISCRIMINATION AND EQUAL OPPORTUNITY EMPLOYMENT
<br />
<br />During the performance of the Contract, the Contractor and its subcontractors shall not
<br />discriminate against any employee or applicant for employment because of race, color, sex
<br />including pregnancy, religion, age, national origin, marital status, political affiliation, familial
<br />status, sexual orientation, gender identity and expression, or disability if qualified. The Contractor
<br />will take affirmative action to ensure that employees and those of its subcontractors are treated
<br />during employment, without regard to their race, color, sex including pregnancy, religion, age,
<br />national origin, marital status, political affiliation, familial status, sexual orientation, gender
<br />identity or expression, or disability if qualified. Such actions must include, but not be limited to,
<br />the following: employment, promotion; demotion or transfer; recruitment or recruitment
<br />advertising, layoff or termination; rates of pay or other forms of compensation; and selection for
<br />training, including apprenticeship. The Contractor and its subcontractors shall agree to post in
<br />conspicuous places, available to its employees and applicants for employment, notices to be
<br />provided by the contracting officer setting forth the provisions of this nondiscrimination clause.
<br />The Contractor further agrees that he/she will ensure that all subcontractors, if any, will be made
