<br />ITB 24-06-02 CITYWIDE LANDSCAPING SERVICES 28 <br /> <br />CITY OF SUNNY ISLES BEACH <br />18070 Collins Ave. | Sunny Isles Beach, FL 33160 <br />305.792.1707 | sibfl.net | Purchasing@sibfl.net <br />The Contractor and its Subcontractors will be solely and directly responsible to the owner and <br />operators of such properties for any damage, injury, expense, loss, inconvenience, delay, suits, <br />actions, or claims of any character brought because of any injuries or damage which may result <br />from the construction operations under the Contract Documents. <br /> <br />Neither the City nor its officers or agents will be responsible to the Contractor for damages as a <br />result of the Contractor’s failure to protect property encountered in the Work. <br /> <br />In the event of interruption to domestic water, sewer, storm drain, or other utility services as a <br />result of accidental breakage due to construction operations, Contractor must promptly notify <br />the owner, any required regulatory authority, and the Project Manager(s). Contractor shall also <br />cooperate with said authority in restoration of service as promptly as possible and bear all costs <br />of repair and any required interim measures to ensure safety. In no event will interruption of any <br />utility service be allowed unless granted by the owner of the utility. <br /> <br />In the event water service lines that interfere with trenching are encountered, the Contractor <br />may, by obtaining prior approval of the water utility, cut the service, dig through, and restore the <br />service with similar and equal materials at the Contractor’s expense and as approved by the <br />Project Manager(s). <br /> <br />The Contractor shall replace with material approved by the Project Manager(s) or Consultant, at <br />Contractor’s expense, any and all other laterals, existing utilities or structures removed or <br />damaged during construction, unless otherwise provided for in the Contract Documents and as <br />approved by the Project Manager(s) or Consultant. <br /> <br />The Contractor shall replace with material approved by the Project Manager or Consultant, at <br />Contractor’s expense, any existing utilities damaged during the Work. <br /> <br />2.28 ACCESS TO WATER AND UTILITIES <br /> <br /> The Contractor is responsible for providing all water and power required for the performance of <br />the Work, including the use of a generator, fuel, etc. The use of a generator may be subject to <br />the prior approval of the Project Manager(s) and may be withheld when the Work is in a primarily <br />residential neighborhood. Electrical power required during construction must be installed by a <br />qualified electrical contractor approved by the Project Manager(s). <br /> <br /> The City may at its sole discretion provide access to City utilities or water should such be available <br />at the Work site. However, the Contractor is responsible to ascertain the location and accessibility <br />of any utilities and potable water sources necessary to perform the Work. The ability of the City <br />to make utilities available to the Contractor must not form any basis for a change order or claim <br />by the Contractor. <br /> <br />2.29 COORDINATION OF THE WORK <br /> <br />Prior to the commencement of the Work under the Contract, the city’s Project Manager(s) will <br />make every effort, based on available information, to notify the Contractor of any ongoing or <br />scheduled project(s) that will be ongoing or commence during the Work on a Project that may
