LPR system is specificially excluded from the Project Scope of Services to be provided by <br />CONTRACTOR to CITY. CONTRACTOR shall provide the Project Scope of Services in strict <br />conformance with Request for Proposal #17-29DD, a copy of which is on file in the offices of <br />the Financial Administration Purchasing Division of CITY and is deemed incorporated by <br />reference into this Agreement. CONTRACTOR covenants to strictly comply with all of the <br />terms and conditions of RFP #17-29DD. In the event of any conflict between the terms set forth <br />in the main body of this Agreement, its attachments and RFP #17-29DD, the terms and <br />conditions set forth in the main body of this Agreement shall control, followed by the terms and <br />conditions set forth in Exhibit A, followed by the terms and conditions set forth in Exhibit B, <br />followed by the terms and conditions within RFP #17-29DD. <br />2. Scope of Services: CONTRACTOR covenants to timely provide the Project Scope of <br />Services. The intersections and approaches within which the Project Scope of Services are to be <br />provided are identified in Exhibit B, a copy of which is attached hereto and incorporated by <br />reference herein. CONTRACTOR covenants to strictly comply with Exhibits A and B. <br />CONTRACTOR is aware of the holding of the Fourth District Court of Appeal in City of <br />Hollywood v. Arem, 154 So. 3d 359 (Fla. 411 DCA 2014), and CONTRACTOR covenants that <br />CONTRACTOR'S procedures do not violate the holding in Arem. Further, CONTRACTOR <br />assures CITY that CONTRACTOR does not use unfettered discretion to decide whether images <br />meet the standard of a traffic violation prior to sending the image for review by a Traffic <br />Infraction Enforcement Officer (hereinafter TIEO). CONTRACTOR retains the authority to <br />review information from a traffic infraction detector pursuant to Section 316.083(1)(a), Florida <br />Statutes. However, only a law enforcement officer and Traffic Enforcement Officers have <br />authority to issue citations for traffic infractions. See Sections 316.0083(3) and 316.640(5), <br />3 <br />
