An Ordinance of the Cite Commission of the City of Sunny Isles Beach. Florida. Amending <br />Chapter 265 "Zoning" Section 265 -18 of the City Code to Require Submission of Costs of <br />Construction of Development Projects and Appraised Value of Artwork Designated for <br />Development Projects in the Site Plan Application Process; Providing for Severability; <br />Providing for Repeal of Conflicting Provisions; Providing for Inclusion in the Code; and <br />Providing for an Effective Date. <br />Action: City Clerk Hines read the title. and City Manager Russo and Zoning <br />Administrator/Planning Manager Claudia Hasbun reported that this is to consolidate the <br />language of the site plan requirements section to reflect requirements that satisfy Section 104 <br />Of the Code. <br />Public Speakers: None <br />Vice Mayor Aelion said he had a question that relates to the project we just approved [Item <br />6B]. There is a cap of $500.000 for artwork to be conducive to the Art in Public Places. As <br />far as the layout is going to be by the developer because the choice of the structure, the <br />critique, and so it is going to be specifically the City's or the charity? Ms. Hasbun said those <br />funds are going to be trust funds for that program. City Attorney Ottinot clarified that the <br />developer has two options, they can either construct a work of art on the site and they will <br />not have to contribute to Arts in Public Places. But if they wish to contribute. those funds <br />will go to the City. Mayor Edelcup asked once the funds go into the Trust Fund, who in the <br />City determines how to use those funds? City Attomev Ottinot said the Citv Commission. <br />Ms. Hasbun said the developers have not decided vet but will come back to the Commission <br />to present that piece of art, if not, they will submit as stipulated in the conditions for the site <br />plan, to provide $500,000 to the Trust Fund. <br />Commissioner Scholl moved and Commissioner Levin seconded a motion to approve the <br />proposed Ordinance on first reading.
