CITY OF SUNNY ISLES BEACH <br />18070 Collins Ave. | Sunny Isles Beach, FL 33160 <br />305.792.1707 | sibfl.net | Purchasing@sibfl.net <br />21 <br />ITB 25-04-01 BELLA VISTA SEAWALL REPLACEMENT <br /> <br /> <br /> <br />2.25 VALUE ENGINEERING <br /> <br />The City is open to any meaningful value engineering that would reduce the overall cost without <br />compromising the integrity. Any innovative idea shall be included in the bid proposal. <br /> <br />2.26 HOURS OF CONSTRUCTION <br />The Contractor shall minimize the impact of this Project on the general public ensuring that all <br />service interruptions are kept to a minimum and providing temporary services, structures, and <br />facilities as required. The existing service to the residents and businesses may not be interrupted <br />for more than 4 hours without written permission from the City. The Contractor shall perform <br />work between the hours 7:00 AM and 7:00 PM Monday through Thursday and 7:00 AM – 5:00 <br />PM on Fridays; and weekends with permission or as restricted by the local jurisdiction. Work <br />outside these hours or on weekends and holidays is prohibited without permission from the City. <br />2.27 WARRANTY <br />All Capital Equipment supplied and installed for this Project shall be warranted to be free of <br />defects for a period of one (1) year after completion of the Project. <br /> <br />2.28 UNITED STATES-PRODUCED IRON AND STEEL PRODUCTS <br />Pursuant to Section 255.0993, Florida Statutes, and subject to the exclusions set forth therein, <br />any iron or steel product permanently incorporated in a public works project must be produced <br />in the United States if the public works project constitutes “an activity paid for with any state <br />appropriated funds or state funds administered by a governmental entity which consists of the <br />construction, maintenance, repair, renovation, remodeling, or improvement of a building, road, <br />street, sewer, storm drain, water system, site development, irrigation system, reclamation <br />project, gas or electrical distribution system, gas or electrical substation, or other facility, project, <br />or portion thereof owned in whole or in part by any governmental entity.” To the extent any Work <br />or Services provided for in this Agreement constitutes a public works project, as defined in Section <br />255.0993, Florida Statutes, subject to the exclusions contained therein, any iron or steel product <br />permanently incorporated in the Work or Services must be produced in the United States. <br />2.28 PUBLIC RECORDS LAW <br /> <br />The City is subject to Chapter 119, Florida Statutes, “Public Records Law.” No claim of <br />confidentiality or proprietary information in all or any portion of a response will be honored unless <br />a specific exemption from the Public Law exists and is cited in the response. An incorrectly claimed <br />exemption does not disqualify the firm, only the exemption claimed. Contractor acknowledges <br />the public shall have access at all reasonable times, to all documents and information pertaining <br />to City’s contracts, subject to the provisions of Chapter 119, Florida Statutes, and agrees to allow <br />access by the City and the public to all documents subject to disclosures under applicable law. To <br />the extent that Contractor has been provided access to or has received security sensitive <br />information, as defined by Florida Statutes, Section 119.071 and/or has executed a Confidential <br />Information Acknowledgement and Agreement as part of the ITB process, Contractor shall keep
