qV,(N• ri(i D a v '-" SECOND AMENDMENT TO THE AGREEMENT BETWEEN THE ` CITY OF SUNNY ISLES BEACH AND CONTOUR or sin MARINE INCORPORATED CONTRACT NO.2023-8507 THIS SECOND AMENDMENT TO THE AGREEMENT between the CITY OF SUNNY ISLES BEACH (hereinafter "City") and CONTOUR MARINE INCORPORATED, whose Federal Employer Identification (FEI) No. is 92-0191940 (hereinafter "Contractor"), executed this 24th day of November, 2025, is made a part of the original Agreement between the Parties dated September 12, 2023, appended hereto as Exhibit "A," and the First Amendment thereto, dated October 31, 2023, appended hereto as Exhibit "B." RECITALS WHEREAS, on October 31, 2023, via Resolution No. 2023-8507, the City Commission approved a First Amendment to the original Agreement between the City and Contractor, dated September 12, 2023, for the assembly and installation of two new 14,000 lb. minimum lifting capacity boat lifts at Bella Vista Park (hereinafter "Agreement''); and WHEREAS, the First Amendment provided additional compensation for "a modification to the design of the boat lifts and to accommodate a finger pier between the lifts, in an amount not to exceed Eight Thousand Dollars and No Cents ($8,000.00);" and WHEREAS, no work pertaining to the re -design of the boat lifts and construction of a finger pier were initiated, and such re -design and finger pier are no longer necessary or part of the project; and WHEREAS, the City now desires to amend the Contractor's Services and provide additional compensation, in addition to the Eight Thousand Dollars and No Cents ($8,000.00) approved in Resolution No. 2023-8507, for the purchase and installation of a stainless -steel gate as part of the project, as more particularly described in Contractor's Estimate, appended hereto as Exhibit "C;" NOW THEREFORE, in consideration of the promises and the mutual covenants set forth herein, the Parties agree as follows: TERMS I. AMENDING SERVICES. City and Contractor hereby agree to amend Section 3 the Agreement, entitled "Services," to provide additional Services as follows: Contractor shall provide equipment and services to the City pursuant to the terms and conditions set forth in the Contract Documents to include the purchase and installation of a stainless -steel gate, as more particularly described in Contractor's Estimate, appended hereto as Exhibit "C." 2. ADDITIONAL COMPENSATION.
