Cm -Clerk <br />RE: Resolution directing the Zoning Administrator to administratively close a private <br />TDR sub - account for Temple B'Nai Zion <br />RECUN MENDATION <br />It is recommended that the City Commission direct the Zoning Administrator to administratively <br />close a private TDR sub - account for Temple B'Nai Zion. Inc. (the "Temple"). <br />REASONS <br />As part of the parties' settlement in the lawsuit styled "Temple B'Nai Zion. Inc. v. City of.Sunny <br />Isles Beach. et al. Case No. 10- 24549- CIV -IGV IV the City agreed to create a private Transfer of <br />Development Rights ( "TDRs ") sub - account for the Temple to transfer up to Fifteen Thousand <br />(15,000) square feet of floor area and five (5) dwelling units. of the existing allowable and <br />unused development rights attributable to the Temple's property located at 200 178'" Street, <br />Sunny Isles Beach, FL 33160. <br />The City Commission wishes to administratively close the Temple's sub - account of 15.000 <br />square feet of floor area and five (5) dwelling units as a result of the sale of such TDRs. <br />
