Page 2 of 4 <br />The proposed Sales Center is consistent with the provisions of Section 265-14 of the <br />Code relating to Temporary Uses, as well as the requirements set forth in the City Code for site <br />plan approval, including conformance with the character of development in the surrounding area, <br />general layout of the site, and architectural design of the structures. It is also consistent with the <br />goals, policies and objectives of the City's Comprehensive Plan. <br />The proposed Sales Center is anticipated to operate seven days a week from <br />approximately 8:00 a.m. to 7:30 p.m., may occasionally host events extending beyond those <br />operating hours, and will be the principal office from which sales representatives will sell and <br />market the condominiums comprising the Multifamily Project. Those real estate sales -related <br />activities are anticipated to commence upon completion of construction of the Sales Center, and <br />conclude within one year of the issuance of the temporary certificate of occupancy of the <br />Multifamily Project. The Property has adequate parking to accommodate the Sales Center's <br />parking demand. <br />The Applicant is requesting a variance for the proposed Sales Center under section <br />265-35.13.(4)(c)[2][a] of the City Code, which requires the side setbacks at the Property to be a <br />minimum of 20 feet. The Sales Center is proposed with a building setback of 14' (11' building <br />overhang setback). The requested variance meets the criteria set forth in Section 265-15.G. of <br />the City Code as follows: <br />(1) Special conditions and circumstances exist which are peculiar to the land, structure, or <br />building involved and which are not applicable to other lands, structures or buildings in <br />the same zoning district; <br />Special conditions and circumstances here are based in large part on the history of <br />development at the Property and the types of buildings that remain at the Property. Namely, the <br />Property is developed with low-rise multifamily structures on its northern portion <br />(to -be -demolished), and an existing sales center on its southern portion. Because the existing <br />sales center on the southern portion of the Property remains active and is slated to -remain, the <br />proposed Sales Center's siting options are limited to the northern portion of the Property, and <br />therefore development design options are significantly restricted. Importantly, the proposed <br />Sales Center is inherently temporary in nature and the proposed Sales Center building is of <br />modest height and intensity in relation to the as -built environment further to the north and south <br />of Property within this same zoning district (which development typology largely consists of <br />modern multifamily towers). The variance is necessary to effectuate the proposed modest <br />temporary use/building in an efficient and appropriate manner. <br />(2) The special conditions and circumstances do not result from the actions of the <br />petitioner; <br />364 <br />
