<br />25 <br />RFP 26-04-01 CITYWIDE HOLIDAY LIGHTING & DECORATING SERVICES <br />CITY OF SUNNY ISLES BEACH <br />18070 Collins Ave. | Sunny Isles Beach, FL 33160 <br />305.792.1707 | sibfl.net | Purchasing@sibfl.net <br />3.6 DELIVERY AND INSTALLATION <br /> <br />Initially, décor shall be delivered, installed and operational at awarded location within the period <br />noted on the notice to proceed. All delivery and installation costs shall be the responsibility of the <br />Contractor. The Contractor is responsible for any damage to the park or city facilities incurred <br />during the contractor’s installation or operational activities. This includes but is not limited to <br />plant damage, damage to the irrigation system, damage to flatwork, buildings, public art, <br />electrical systems, sound systems, lighting systems, or park amenities such as trashcans or <br />benches. At the direction of the City, the Contractor will repair or reimburse the City to repair any <br />damage. <br /> <br />3.7 MAINTENANCE <br /> <br />The Contractor must operate and maintain the premises in good and safe conditions and in <br />accordance with industry standards. This maintenance includes, but is not limited to, the <br />maintenance and repair of all lights and equipment. Other safety or maintenance concerns, <br />including all interior and exterior structures, building systems, utility systems and connections, <br />sewer systems and connections, equipment, lighting, sidewalks, paved areas, temporary <br />structures, gutters, curbs, and fixtures, should be immediately communicated to the City’s <br />representative. Proposer shall submit a maintenance plan with their proposal. <br /> <br />3.8 LOCAL, STATE, AND FEDERAL COMPLIANCE REQUIREMENTS <br /> <br />Proposer agrees to comply, subject to applicable professional standards, with the provisions of <br />any and all applicable Federal, State, County and City orders, statutes, ordinances, rules and <br />regulations which may pertain to the Services required under the Agreement, including but not <br />limited to: <br /> <br />a. Occupational Safety and Health Act (OSHA) <br />b. 7th Edition (2020) of the Florida Building Code (and all referenced standards contained <br />within) <br />c. National Electric Code <br />d. UL Listed <br />e. Equal Employment Opportunity (EEO) <br />f. Americans with Disabilities Act (ADA) <br />g. "Conflicts of Interest" Section 2-11 of the County Code. <br /> <br />The City reserves the right to inspect with or without notice. <br />3.9 THE CITY’S ROLE AND RESPONSIBILITY <br /> <br /> Sufficient power supply shall be provided by the City. <br /> <br />3.10 RELEASE OF LIABILITY <br /> <br />The Contractor shall release and discharge the City of Sunny Isles Beach from any and all liability <br />for loss of merchandise, goods, equipment or other property of the Contractor or his agents if
