(17395 +Ce 2� ) <br />Agenda item 5.A <br />PZ2026-07 (Conditional Use for A Child Day Care Facility) <br />Dear Mayor: <br />This firm represents Sunshine State Academy ("Sunshine"), owner and operator of early <br />childhood, elementary and middle schools within the vicinity of the proposed child day care <br />facility. While Sunshine does not oppose the Request for a Conditional Use for a Child Day Care <br />Facilily, Sunshine does have serious concerns that warrant the Commission's attention and review <br />mandating a condition of approval in order to protect the health, safety and welfare of the children <br />attending the facility. <br />Specifically, Sunshine is concerned, and has heard from different sources, that the applicant <br />is merely a strawman utilized solely to obtain the conditional use as a bait and switch, at which <br />point the properly will be leased to a new unscrupulous operator, who would be unvetted, and <br />outside of the review and approval of the City Commission. The majority of municipalities in <br />Miami -Dade County tie the approval of a Conditional Use to the actual applicant. However, the <br />City's code ties the approval to the actual property, which opens the door for abuse and the <br />concerns of a bait and switch to an unscrupulous operator. Accordingly, we implore the <br />Commission to add, as a condition of approval, that the Conditional Use solely authorizes Sunny <br />Smart Corp., to operate the facility, and any change of the lease or operator requires the submittal <br />of a new application. <br />Thank you for your assistance in this matter. <br />Very truly yours <br />chard Dewitt <br />
